Banks 4694 Telescope Avenue Carlsbad, CA 92008 SWCX ADMINISlRAlTvE VARIANCE NO. 91-16 - Request for a deck intrusion into the rear yard on property immediately adjacent to permanent open space. Dear Mr. and Mrs. Banks: The Planning Director has completed a review of your application for an Administrative Variance, AV 91-16, at 4694 Telescope. After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the three findings required for granting an Administrative Variance for an intrusion into the rear yard can be made and, therefore, approves this request based on the following findings and conditions. 1. 2. 3. The granting of this variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the property is located because the deck is designed to be compatible with the existing structure and will not cause any adverse physical or visual impacts to neighboring uses. The granting of this variance will not adversely affect the comprehensive General Plan because the presence of the deck does not alter the use allowed on or density of the site. The approval of this variance will not cause any adverse physical or visual impacts on adjacent properties because the deck is designed to be compatible with the existing structure and will not be unsightly when viewed from adjacent structures or from the street behind the open space. 1. Approval is granted for AV 91-16, as shown on Exhibits "A" - "C", dated February 26, 1992, incorporated by reference and on file in the Planning Department. Appeals must be submitted in writing to the Planning Commission at 2075 Las Palmas Drive in Carlsbad, along with a payment of $110.00. The filing of such appeal within such time limit shall stay the effective date of the order of the Planning Director until such time as a final decision on the appeal is reached.
