Explain why there are exceptional or extraordinary circumstances or conditions applicable to the property or to the intended use that do not apply generally to the other property or class of use in the same vicinity and zone: The overall bulk of the residence and steepness of the street tends to minimize the impact of having the R.V. parked in the driveway. Explain why the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located: The R.V. is not parked in a public right of way and does not block anyone's view. The stee~ness of the street orovides an opportunity for the eye to view the entire neighborhood and not focus on one vehicle parked in the driveway. ~~~ ~~~~~~~ ~~ ~~~ 4. Explain why the granting of such variance will not adversely affect the comprehensive plan: The houses in the area are very large and the RV does not seem out of place in the setting. Affluent neighborhoods often contain people with such vehicles. The vehicle is used on a regular basis and is often out oi tne arlvewar Tor tour to six weeks at a time. Addendum: During remodeling of this property I originally planned to provide a sight on the south-east side of the house directly behind where the RV is now parked. Engineering and surveying plans were submitted to the planning board of Carlsbad to develop this space. However, this application was denied. After the contractor and I reviewed the regulations concerning the parking of an RV in the driveway, we determined that we would not be in violation providing a sight in the driveway. Therefore the driveway was extended and strengthened and electrical connections were provided at significant expense to accommodate this vehicle. I still find no conflict with the regulations. It is necessary to maintain a parking sight on my property for several reasons. First, there are no ~a~tisfactory rental sights in the area and it would be extremely expensive to rent such a space even if it were available. Secondly, it is necessary to maintain electricity to the vehicle in order to keep the batteries charged and preserve the electrical appliances in the RV. Thirdly, it is necessary to have it where security may be maintained. I JUSTIFICATION FOR VARIANCE 1 By law a Variance may be approved only if certain facts are found to exist. A variance may be approved as an administrative act by either the Planning Commission or the Planning Director. A variance which can be approved by the Planning Director is known as an Administrative variance and is limited to the following: - 1. Modification of distance or area regulations, provided such modification does not exceed seventy-five percent of required front, side or rear yards nor exceed ten percent of maximum lot coverage regulations; not result in a lot width less than fifty (50) feet; 2. Modification of the minimum lot width regulation, provided such modification does 3. Walls or fences to exceed heights permitted by the zoning regulations; 4.
