HomeMy WebLinkAboutAV 92-01; Edwards Amos Administrative Variance; Administrative Variance (AV) (4)March 9, 1992 Mr. John Blake 1739 Red Barn Road Encinitas, CA 92024 SUBJECT: AV 92-1 - EDWARDS/AMOS ADMINISTRATIVE VARIANCE During project review of the subject application, which was deemed complete on February 14,1992, the Planning Department has identified the following issues of concern which must be resolved prior to scheduling the project for Planning Director decision: 1. The Edward's residence 6' masonry fence in the front yard setback exceeds the maximum fence height of 42". Additionally, there is a motorhome (recreational vehicle) parked in the front yard setback in violation of Chapter 21.44.06(2) of the Zoning Ordinance (copy attached). Separate administrative variance applications may be submitted for each of these violations, however, findings required for approval of a fence variance include: 1) there are exceptional or extraordinary circumstances or conditions applicable to the property or to the intended use that do not apply generally to other properties in the same vicinity; 2) the requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity but which is denied to the property in question; 3) the granting of this variance will not be materially detrimental to the public welfare in which the property is located. Based on staff's site inspection, these findings would be difficult to make since fences in the vicinity appear to conform to the 42' maximum height standard and the 6 wall appears to interfere with sight distance. These violations must be resolved through removal or application for and approval of administrative variances for the fence and motorhome prior to Planning Director decision regarding the subject request for an administrative variance allowing a reduced side yard setback. 2. A conflict exists with the proposed boundary and sewer lateral serving Lot 720. This must be resolved through a private easement prior to approval of an adjustment plat.
