SUBJE(X: ADMINISTRATIVE VAlUANCE NO. 92-08 - Request to allow a patio cover to
encroach 8'2" into the required 10 foot rear yard setback at 2707
Southampton Road.
Dear Mr. Portner:
The Planning Director has completed a review of your application for an Administrative
Variance, to allow a patio cover to encroach 8 feet 2 inches into the required 10 foot rear
yard setback at 2707 Southampton Road. After careful consideration of the circumstances
surrounding this request, the Planning Director has determined that the three findings
required for granting an Administrative Variance pursuant to Section 21.46.120(7) of the
Carlsbad Municipal Code be made and, therefore, APPROVES this request based on
the following findings and conditions.
1. The panting of this variance will not be materially detrimental to the public welfare
or injurious to the property or improvements in the vicinity and zone in which the
property is located because the patio cover is compatible with the existing structure
and minor in size (140 square feet in area).
2. The granting of this variance will not adversely affect the Comprehensive General
Plan because the patio cover does not alter the use allowed on or density of the site.
3. No adverse physical or visual impacts are anticipated, as the patio cover is
compatible with the existing structure and does not interfere with adjacent
property's views. The rear of the property is buffered from adjacent streets by steep
topography designated as open space.

Conditions:
1. Approval is granted for AV 92-08, as shown on Exhibits "A-C", dated January 12,
1993, incorporated by reference and on file in the planning department.
Development shall occur substantially as shown.
2. The patio cover shall remain unenclosed as required per Subsection 21.46.120(7)(A)
of the Carlsbad Municipal Code.
This decision may be appealed by you or any member of the public to the Planning
Commission within ten days of receipt of this letter. Appeals must be submitted in writing
to the Planning Commission at 2075 Las Palmas Drive in Carlsbad, along with a payment
of $110.00. The filing of such appeal within such time limit shall stay the. effective date of
the order of the Planning Director until such time as a final decision on the appeal is
