A variance application is required whenever an applicant desires a variance from the requirements of the zoning code. A variance may be approved as an administrative act by either the Planning
Commission or the Planning Director. A variance which can be approved by the Planning Director
is known as an Administrative variance and is limited to the following:
1. Modification of distance or area regulations, provided such modification does not
exceed seventy-five percent of required front, side or rear yards nor exceed ten
percent of maximum lot coverage regulations;
2. Modification of the minimum lot width regulation, provided such modification dues
not result in a lot width less than fifty (SO) feet;
3. Walls or fences to exceed heights permitted by the zoning regulations;
4. Modifications to the sign area regulations, provided such modification does not

exceed ten percent of the maximum allowed sign area;

8. Propertv Owners' List and Addressed Labels
- A typewritten list of names and addresses of all property owners within
a 300 foot radius of subject property (including the applicant and/or owner). The list shall include the San Diego County Assessois parcel gtj 1 from.the latest assessment rolls.

JUSTIFICATION FOR VARIANCE
The following answers are applicable to the questions attached.

1. The minimum distance between the common property line and the solarium is 5’. Due
to the angle of the property line, the maximum distance is 6’. The solarium is blocked
from the street by a wooden fence which is approximately 5’ high. The house is within
a gated community and within the community there are houses which are placed as close
as 4’4” from the street. The granting of this permit does not interfere with the general
community or with the common ground of the community. The variance does not
change the use of the property.

2. Our house is not large enough for us to use our dining room for family gatherings
without the additional room which is obtained by the solarium. We would be deprived
of a material property right if we are not able to make this slight modification to the
house. We believe the addition requested is not in violation of the purpose of the set
back requirements.
3. The granting of the permit is not detrimental to the public because the solarium is not a
high structure, it does not intrude within the common area and is set back 5’ from the
side yard fence. The solarium is only 10’ long and does not create a barrier or obstruct
light and air on the adjoining common area. There are other private residences within
the same Project which are closer to the common boundary that the proposed variance
which is requested. This variance does not impose any detriment on the community.
4. The comprehensive plan is for this to be a residential community. The variance is
simply for a small glassed in room of approximately 60 square feet. This is within the
intended purpose and intent of the comprehensive plan and is not inconsistent with the
comprehensive plan in any way.
