Phases IV & V, C.T. 90-23
Dear Christer:
This letter is to memorialize our telephone conversation of Thursday, July 14, 1994 regarding
rear yard improvements on Fairways, Phases IV and V, C.T. 90-23.
Pursuant to Section 21.46.120 (7) of the City’s zoning ordinance, unenclosed balconies, patios
and decks which extend above the existing ground level may intrude into required rear or side
yards immediately adjacent to permanent open space areas upon approval of the land use
planning manager and that the land use planning manager shall find that approval of such a
variance will not cause any adverse physical or visual impacts on adjacent properties.
In Phase IV lots 63 thruk inclusive, have rear yards which abut a permanent open space, as
do lots Ia3~~135, l.&+WF thru 146, inclusive, in Phase V. These lots meet the requirements
of Section 21.46.120 (7) and therefore, may qualify for an administrative variance. We will
submit to the planning department an application for an administrative variance for these lots.
Lots 434m 47pO thru 54, k 5? ZY and lot 1$ lots
20 thru 32 in ase V all have sufficient lot sizes that will not require encroachment into the
required rear yards.

Lot 13 1 in Phase V has a plan type 4. The approved architectural plans show an optional
balcony for that particular floor plan in the exterior recessed comer without encroachment into
the rear yard. An administrative variance would not be required for a balcony constructed per
this plan on this lot.
Lots 48 and 55 in Phase IV and lot 132 in Phase V do not meet the requirements of Section
2 1.46.120 (7) and do not have sufficient area for these types of rear yard improvements.
Individual variances must be requested for these lots if a balcony, patio or deck is desired.

As a note, lots 49, 56, 60, 68, UHMMPhase IV and lots 19, TMand 136 in
Phase V are open space lots.
