This variance is for the Carlsbad Shell at 1145 Carlsbad Village Drive, recently processed for a Conditional Use Permit (staff planner Teresa Woods). At a very late point in processing we were informed of a requirement in landscaping not considered applicable earlier, (6’ minimum perimeter planters). Tait & Associates reworked the site plan to comply with this requirement - four areas remained non-complying going into hearing. Terry made a very detailed and complete presentation to the Planning Commission (Wednesday, November 2, 1994). Staff recommendations were given with regards to the four areas along the perimeter which did not meet the 6’ minimum planter depth. City staff supported one for variance and did not support the other three. At hearing Shell Oil and the station owner agreed to loose two parking spaces and provide continuous 6’ wide planters in two of the four areas. Due to the restraining factors of existing structures to remain and in consideration of safety to patrons and property, two areas must remain non-complying (as described in the Variance Justification Form). Keeping in mind this project site is in a scenic corridor, planting at the two non-complying planters is greatly enhanced to meet the intent of the ordinance.
