August 11,1995 Dermis Petersotl 4928 Loma Way carlsbad, CA 92008 SURJECT: ADMINISTRATIVE VARIANCE NO. 95-03 - Request to park a boat and t&r in the front yard of a single hiiy lot at 4928 Loma Way. The Planning Director has completed a review of your application for an Administtative Variance, AV 95-03 to allow a boat and trailer in the front yard of a single family lot at-4928 Loma Way. After careful consideration of the circwn~rrnces sunounding this request, the Planning Director has determined that acccs to the si& and rear yard cannot be provided and therefore, APPROVES this quest based on the following findings and conditions. Findinq 1. 2. 3. 'Whether parking in or access to the side or rear yard would quire structural alteration to the existing residence or would require the removal of signifiiant or unque landscaping. A fence shall not be deemed to prevent access to the side or rear yard.' Access to the si& or rear yard would either require structural alterations to the existing residence or the removal of significant landscaping. The boat and aailer cannot be parked on the east side of the property without making significant structural alterations to the residence. Accessing the street side yard from the front of the property would require removal of at least one large palm tree and patio landscaping. Accessing the stnet side yard from Loma Laguna Drive would require removal of a significant amount of patio landscape and hardscape. Acccsing the rear yard would not only quim removal of patio landscaping and hardscape, but would also require removal of aswimmingpod 'Whether parking in or access to the side or rear yard would require extensive grading.' Rear yard accts~ and storage would require regrading of a slope located between the pod and Loma Laguna Drive as well as leveling the pool with soil or other appropriate fill material. Little to no grading would be required for access to the side yards However, the interior side yard is too MITOW to accommodate the boat and access to the street side yard is blocked by hardscape and mam landscaping. 'Whether because of the confiiratioo of the lot, existing landscaping, the location of the structurea on the lot, and the size of the recreational vehicle, parking of the recreational vehicle in the front yard would interfere with visibility to or from any street,' Visibility to or from Loma Way or Loma Laguna Drive would not be disrupted by parking the trailer and boat in the driveway. 2075 Las Palmas Drive - Carlsbad, California 92009-1 576 - (619) 438-1 161 @ 1 " I 't ' c 1 AV 95.03 - PETERSON PARKING LOT .. 'Whether allowing parking of the recreational vehicle in the front yard would interfere witb tMi on the street or sidewalk or would encroach into the street and utility right-of-way.' The boat and trailer can be parked on the east side of the driveway without encroaching into the public right-of-way. The boat and trailer will not interfere with traffic on the street or sidewalk as long as it remains outside the public right-of-way. Condition$: 1. In order to comply with Section 21.44.060(2)(C) of the Carlsbad Municipal Code, which states that "the area for parking the tecnation vehicle in the front yard shall not excd the maximum paved ana permitted for passenger vehicles", the paved driveway ma be reduced to 24 feet in width. The reamfigured driveway shall be designed in accordance with Exhibit "A", on file in the Planning Department This design would position the boat and trailer such that it would not pnclude vehicle access to the garage. Permanent parking of the boat and trailer is restricted to the paved portion of the property in accordance with this design. Any alternative design shall require the pianning Di~ector's approval. 2. Additional landscaping shall be instelled along the east side of the driveway to improve screening of the boat and trailer from neighbors to the west. A plan indicating plant type and location shall be submitted to the Planning Department. The plan is subject to the Planning Director's review and approval. 3. The boat and trailer shall be parked such that it docs not encroach into the public right-of-way. THIS PLANNING DIRDXOR DETERMINATION IS NOT VALID UNTIL THE ABOVE CONDITIONS ARE SATISFIED. This decision may be appealed by you or any member of the public to the City Council within ten days of nceipt of this letter. Appeals must be submitted in writing to the City Clerk's Office at 1200 carlsbad Village Drive in Carlshd, along with a payment of $120.00. The filingofsuchappealwithinsuchtimlimitshallstaythedftctivedateoftheorderofthePiatlning Director until such time as a final decisicm on the appeal is reached.
