Dear Ms. Hysong,
Thank you for the phone call yesterday responding to our letter of 16 October 4 995
on the subject Case Fite. We appreciate your explanation of the zoning
regulations governing Bristol Cove, but we would like you to take note of the
attachment, a free flyer obtained from a dispensing display in front of the property
at 4571 We Drive. It clearly advertises the building as being for sale, at
$329,000.
From this flyer, it is obvious that the builder is offering to sell the property as a
condo, even before an Administrative Variance is aranted bv the Citv of Carlsbad!
This has been his plan from the beginning. Perhaps a case can be made that his
original permit was obtained fraudulently.
As a result of our letter of 16 October 1995, the Bristol Cove Property Owners'
Association has asked me look into revision of our CC&Rs and to prepare a
petition to the City Council requesting a change to the present zoning regulations
to prevent such maneuvers as the few remaining properties on Bristol Cove are
developed.
As stated in our letter of 16 October 1995, we oppose granting an administrative
variance on the subject property.
