HomeMy WebLinkAboutAV 96-01; Campbell Residence; Administrative Variance (AV)July 23, 1996 Tom Campbell 2603 Wagon Wheel Rd Oxnard, CA 93030 SUBJECT: AV 96-01 - CAMPBELL RESIDENCE Dear Mr. Campbell: The Planning Director has completed a review of your application for an Administrative Variance, AV 96-01 , on Lot 10 and 1 1 of Map 201 3 of La Costa Downs Unit No. 1. After careful consideration of the circumstances surrounding this request, the Planning Director has determined that the four findings required for granting an Administrative Variance CAN be made and therefore, APPROVES this request based on the following findings and conditions. 1. There ARE exceptional or extraordinary circumstances or conditions applicable to both properties that do not apply generally to the other properties in the same vicinity and zone. Lot 10 and 11 contain less developable area than the other lots of the subdivision due to their location at the end of their respective CUI de sacs and a 30 foot wide utility easement on the south side of the properties. These factors limit Lot 10 to 1,600 square feet of developable pad with an irregular configuration due to a curved front property line. Lot 11 is reduced to 875 square feet due to the same constraints as Lot 10. Developers of these lots are at a disadvantage when compared with the rectangular 2,000 square foot developable pad as exemplified by most lots in the subdivision. 2. The requested variance IS necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone but which is denied to the property in question because other properties have the advantage of being fully developable and capable of supporting homes of a reasonable size and shape. 3. The granting of this variance WOULD NOT be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which the property is located. In addition, the integrity and comfort of the neighborhood would not be jeopardized. The subject properties front on CUI de sac bulbs which place the buildings farther back from the street center line than other homes fronting the street, even with the reduced front yards. Since the subject property's homes would still fall behind the "string line" of homes fronting the linear portion of the street, the impacts from the reduced set backs would be minimized. In addition, since the proposed houses do not require complete utilization of the reduced set back area, any possible impacts would not reach their full potential. 4. The granting of this variance WILL NOT adversely affect the comprehensive General Plan because the variance applies only to two lots which have unique circumstances unlike the majority of lots within the City. This decision may be appealed by you or any member of the public to the Planning Commission within ten days of receipt of this letter. Appeals must be submitted in writing to the Planning Commission at 2075 Las Palmas Drive in Carlsbad, along with a payment of $1 20.00.
