Listed below are the issues raised by staff. Please note that the purpose of a preliminary review is to provide you with direction and comments on the overall concept of your project. The preliminary review does not represent an in-depth analvsis of Your proiect. Additional issues of concern mav be raised after your application is submitted and processed for a more specific and detailed review. PlanninP: 1. As indicated by your correspondence of 1 1-01-96, your home is non-conforming by reason of inadequate yards. The planning director has the authority to grant variances to the zoning provisions of the municipal code where yard modification does not exceed seventy-five percent of required front or side yards (the area in which your property exhibits nonconformity), where specific findings as prescribed by Chapter 21.5 1 can be made. This is the apparent relief from the code that has allowed some of your neighbors to enjoy remodels that exceeded 40% of the existing floor area, eventhough they also exhibited non-conforming yards. Without specific improvement plans staff may only speculate about your remodel. Based on your statement that you wish to be in setback alignment (meaning a string line attached from the front or back of your neighbors’ houses which would not intercept your structure) with your neighbors on both the street and ocean side of your property and assuming a standard second story, the front and sideyard setbacks would be the object of the administrative variance. Obviously, a full review of your future plans may reveal other areas of concern. Engineering: 1. The dimension of the flow line of the rolled curb to the property line was omitted. The existing neighborhood does not have sidewalk.
