RE: AV 98-02KP 98-03 - WORTH CONDO CONVERSION
Dear Mr. Worth:
After a most thorough review of the Administrative Variance application, Staff cannot
make the necessary findings for the approval of a reduced front yard setback. There are
no unusual circumstances or conditions applicable to the property that do not apply to
other properties in the same area. Other properties have equal lot areas, lot widths, and
the same development constraints as the subject property. There is not a denial of a
substantial property right possessed by others but which is denied by the subject property.
Other properties have similar setbacks since they are all developed under the R-W zone
requirements of the Zoning Ordinance.
The site is developed with two units which is the same as many other lots in the same
area, but the original design and placement of the units is what precludes the conversion
of the units to a condominium project. Specifically, the parking requirement of two
spaces per unit and the one guest space is what prevents the conversion of the units. The
parking spaces shown on the plan are not the 8 % by 20 foot space required by the Zoning
Ordinance. The true plotting of the spaces puts the guest space 4 % feet over the property
line into the public right-of-way. All required parking must be provided on site.
Please let me know what your intentions are regarding these applications. If you wish to
withdraw the applications, a portion of the application fees can be refhded. If the project
is denied, you will have the opportunity to appeal staffs decision to the Planning
Commission.
