SUBJECT: PRE 98-56 - DAY RESIDENCE

A preliminary review of your project was conducted on October 29, 1998. Listed below are the
issues raised by staff. Please note that the purpose of a preliminary review is to provide you with
direction and comments on the overall concept of your project. The preliminarv review does
not remesent an in-depth analysis of vour proiect. Additional issues of concern may be
raised after vour application is submitted and Drocessed for a more sDecific and detailed
review.

The project will require the processing of a Coastal Development permit for the removal and
construction of the home. The property is also located within the appeal jurisdiction of the
California Coastal Commission. The Coastal Commission will have the opportunity to
review the project for conformance to the Local Coastal Program.
An Administrative Variance will be required for the reduced side yard setback. The side yard
setback is required to be not less than ten percent of the lot width. The 74.97' lot width will
require a seven and one half foot side yard setback. Because of the lot's above minimum
width, the justification for a reduced side yard setback would be difficult to justify. Staff
recommends that the required setbacks be provided.
The retaining wall along the southern property line exceeds the six foot maximum allowed
within the setbacks.
The building height as shown on the building elevations may or may not meet the 30 ft
maximum allowed. Additional information is needed to ensure that the lower floor truly
meets the Carlsbad Zoning Ordinance's definition of a basement. Building height is
measured from the more restrictive (lowest) of finished or existing grade. If the lower floor
qualifies as a basement (see definitions) then the building height would be measured from the
existing grade.

5. The project will require a five foot dedication of Ocean Street (See engineering’s comments
below). This will require that an Administrative Variance for a reduced front yard setback be
processed. Unlike the side yard, there is potential support for this application.
6. Does the site need two water meters?
7. In regards to the placement of appurtenances (decks, gazebo, pool and fire pit) in an area that
was previously undeveloped, the Coastal Shoreline Development Overlay Zone states that no
excavation, grading or deposits of natural materials shall be permitted on the beach or on the
face of the bluff. When plans are submitted for the review of the project, please show the
improvements on the adjacent lots to the immediate north and south. These adjacent
improvements may establish a “stringline” that will define where improvements on the
subject lot may be placed. Because the Coastal Development Permit application no. 6-82-
153 has expired, the “stringline” established by that permit is no longer valid.
8. The plans note that the existing single-family residence may be relocated. The relocation of
an existing structure would require a Structure Relocation permit.
EnPineerinF;
1. Show flood plain data. A Special Use Permit may be required based on this information.
2. Five feet of property frontage must dedicated for street right-of-way purposes. This
dedication is necessary to obtain the ultimate 50 foot wide right-of-way planned for Ocean
Street.
3. The existing curb must be replaced with new sidewalk, curb, gutter and street improvements.
The new curb shall be located 20 feet from street center line, and the sidewalk shall be 5 feet
wide. Plans for these improvements will need to be submitted for plan check through a
process separate from application for discretionary permits (Coastal Development Permits,
Special Use Permits, etc.).
4. A sewer pump may be necessary for first level facilities.
5. It appears that over four vertical feet of soil will be removed at the rear of the property. This
cut indicates that a grading permit may be required. Additional information, such as the
quantity of cut, fill, import, export, and remedial grading outside the building foundation is
needed to make a final determination.
