JUSTIFICATION FOR VARIANCE
By law a Variance may be approved only if certain facts are found to exist. Please read these
requirements carefully and explain how the proposed project meets each of these facts. Use additional
sheets if necessary.
1. Explain why there are exceptional or extraordinary circumstances or conditions applicable to the
property or to the intended use that do not apply generally to the other property or class of use in
the same vicinity and zone:
Due to prior approved permit on existing house, planning dept. allowed for a
remodel of 2-car Garage space conversion, thusly would like to bring the off-
street parking back up tocode by proposing the construction of this new 2-car
Garage.
2. Explain why such variance is necessary for the preservation and enjoyment of a substantial
property right possessed by other property in the same vicinity and zone but which is denied to
the property in question:
Kepping the off-street parking to code would allow the owners of this property
to substanially enjoy the right of other property owners in the neighborhood,
& would keep vehicles off street front.
3. Explain why the granting of such variance will not be materially detrimental to the public
welfare or injurious to the property or improvements in such vicinity and zone in which the
property is located:

Description/Explanation:
Due to prior appraved permit on existing house, Planning Dept. allowed
for a remodel of a garage conversion. Thusly the propsal of a new 2-Car
Garage to the rear of existing house, satisfying off-street parking code.

JUSTIFICATION FOR VARIANCE
1. Explain why there are excephonal or extraordinary circumstances
the intended use that do not apply generally to the other property or class of use in the Same vicinity and zone:
In the above question “pro&r@’: and ‘other property or class of use ’’ is not limited to land
What dflers about this ‘property” is that it was purchased as a single family residence, without a
two car garage. The garage conversion took place prior to our ownership and was permitted by
the City. The property was purchased and remains Non-conforming per Ciy Standards and is not
consistent with other homes in the area
2. Explain why such a variance is necessary for the preservation and enjoyment of a substantial
property right possessed by other properties in the same vicinity and zone but which is denied to the property in question
Currently, without a two car garage, our home is Non-conforming and is not comparable with
other homes in the neighborhood. Storage is limited and we only have of street parking. We are
also denied the ability to add on to our home, increase its value and comparability with other
homes within the City.
3. Bxplain why the granting of such variance will not be detrimental to the public welfare or
injurious to the property or impmanens in such vicinity and zone in which the property is
located:
The variance, “if approved” is only for 13’ of encroachment into a rear yard setback. Total
square footage of encroachment, roughly 286 sq. ji. It would be located at the rear of the
property, behind our home, approximately 85’9om the public right of way. . It is serviced by an
existing recorded easement and is nearly out ofpublic view. Further, if there were room to build a
detached garage, the variance, for setback, would be a non-issue. By code I could build within 5’
of my proper9 line, encroaching 330 sq. 9.
4. Explain why the granting of such variance will not adversely affect the comprehensive ped
plan.
By granting this variance, I will be encroaching less on my rear yard setback and the ‘@vvisions
of adequate light nnd ventilation. This home with a 2 car mrme will be consistent w’th the
neighborhood and the City’s General Plan. It would also add value to our home and serve as a
more valuable Comparable to other home owners as well.
