Everson for a reduction of the sideyard setback from 7.5' to 5' (see attached letter). Upon field investigation by Don Rose and myself, the following information was found: 1. There exists extreme topographical circumstances in that the house is located on fill material and its foundation is approximately 10 to 15 feet higher than the adjacent property (see attached photos). 2. The adjacent house is set back approximately 29' from the side property line and the likelihood of sideyard encroachment is minimal. 3. The existing slope would preclude any new additions into the required si deyard setback . 4. The adjacent house is currently owned by the developer and is un- occupied . Based on these findings, it is recomnended that a sideyard reduction be granted, as per Section 21.10.040 A(3). It is further felt that, in this case, the adjacent owner need not be notified in that application of 21.10.040 A(3) allows him a similar reduced sideyard in the event extreme topographical ci rcumstances exist.
