SUBJECT : Request for a Sideyard Reduction at 3057 Hiqhland
Avenue as per Section 21.10.040 A(2).
The request is by Billy C. McColey for a sideyard setback
reduction from 7.5' to 5'. This is to allow for the construction of a carport between his existing house and his northern property line. Upon investigation, the following findings were made :
1. The carport as designed cannot be placed so as to meet both the code requirements for minimum sideyard set- back of 7.5' and a minimum distance between buildings of 10' (see attached building plan).
2. The carport cannot be easily attached to the existing dwelling due to the differences of elevation. The driveway slopes down from the street.
3. The adjacent property has an existing structure which is setback over 25'. The adjacent property owner has been notified and has signed a letter stating that he is aware that he will not be allowed a similar reduction. (See attached photos and letter.)
Based on these findings, I recommend that the sideyard setback
reduction be allowed as per Section 21.10.040 A(2).
