April 10, 1978 Richard Stark Associates ARCHITECT AIA 435 Zuni Drive Del Mar, California 92014 TELEPHONE: (714) 729-1181 SUBJECT: DETERMINATION - SIDEYARD SETBACK Dear Mr. Stark: I have reviewed your two site plans on Tierra del Oro, lots identified as book 210, page 202, lot 19 & 20. Both of these lots are at the end of a cul-de-sac with a depth that is relatively deep in relation with the width. . The width of . these lots is 51.16 feet. The lots are irregularly shaped with a 90 bend. By Code, sideyard setbacks must be 10% of the lot width but shall not be less than 5' nor greater than 10'. Generally the lot width on the subject two lots is 51.77 feet. However, because lot width is measured at the arch of the front yard setback line which in this case is within the smaller portion of the end of the lot, the required sideyard setback is closer to.10'. Therefore, an incon- sistency has been created by applying the zone requirements strictly to these two lots. However, the R-1 Zone provides that in the event special circumstances exist, such as irregularly shaped lots, such as those that front on cul-de-sacs, the Director of Planning may approve the application of a reduced side yard adjacent to a reduced side yard, subject to the fact that there will be 10 feet between buildings. I have reviewed the distance between lot 19 and the adjacent lot to the south and find that it also has a reduced side yard of 5' and therefore a 5' setback on lot 19 will still maintain the 10' requirement. Obviously the distance between building on lot 19 & 20, both being new developments would be at least 10'. There is no development to the north since this property is owned by SDG&E and not to be developed for residential use. I therefore find that the required side yards of lot 19 & 20 of page 020, book 210 need not be less than 5.1 feet.
