Under the provisions of the R-1 Zone in the Carlsbad Zoning Ordinance, the sideyard setback on an interior lot-is 10% of the lot width, not to be less than 5' ; mver, not needing to exceed 10' . The lot width of your house is 75', thus a 7.5' setback is required by strict interpretation of the ordinance. The R-1 Zone, however, does provide for reduction of th sideyard setback requirerent by Planning Director approval. Upon review of pur plan, the folluwimg findings were mde: L . ~. .. - ! 1. The building on the atljacent property is sufficiently set back so as to allow for sufficient open space and access. 2. The adjacent property owner has been notified and has signed a letter stating that he is aware that he will not be allow& a similar reduction. As per Section 21.10.040 A(l), I find that the sideyard setback on the south side of lot 208 of Terramar Unit No. 6, located at 54413~s Fobles, need not be greater than 5'; huwever, the south sideyard on the lot mt be at least 10'. Your building plans will be reviewed based on these requir".
