Last year a code violation case was opened on the property because of the conversion of the storage area into habitable space. Upon receipt of the violation from the city, the property owner investigated options for compliance as reflected and summarized with the Preliminary Review process and specifically PRE 07-29 with corresponding city letter dated December 4,2007. Subsequent discussions with staff to refine compliance options resulted in the concept of adding an onsite managerial unit and increasing the common recreation facilities.This concept was supported by Planning staff as reflected in supplemental email correspondence dated December 20,2007 and attached to this application for background.One important disclaimer made by staff regarding this conceptual support was for us to verify and confirm applicable building and fire code details. Based on this initial support, and related research of codes, our proposal was developed through site visits and contact with various city staff and Esgil. Proposal: The addition of an onsite managerial unit for daytime use is not possible because it would trigger ADA accessibility (in the second floor were the onsite manager would be located)and fire/bldg code issues.Since it does not exist downstairs,it can not be proposed upstairs (without considerable cost). Therefore, our proposal involves: •1'Floor remains as is:common recreation/clubhouse, ADA restroom and gym. •2nd Floor retains most of the approved storage,with new minor changed configuration,and also includes new common gym space and companion restroom.The justification is that accessible gym area is provided on the first floor as well as the second floor. The proposed second floor restroom is justified by the fact that 1st floor has an ADA accessible restroom next to the gym area. •The second floor existing storage is justified by having accessible storage below in the first floor area as well. Additional storage is possible via 3 Unused Garage Spaces located underneath this area as also shown on the attached plans. •Concept is consistent with staff comments received via the December 20,2007 email and also complies with applicable building and fire codes.Once the concept is approved,construction documents need to be done and processed thru the city &Esgil prior to construction and occupancy.
