SUBJECT: CONSISTENCY DETERMINATION FOR CD 13-07-83 DEGREES (RP ll-14(A))
The City Planner has completed a review of your application for a Consistency Determination for the
property located at 660 Carlsbad Village Drive (APN: 203-304-26), which is a modification to Catch
Restaurant (RP 11-14(A)) (now doing business as 83 Degrees), to add 448 square feet of outdoor dining
area and relocate parking spaces on-site. The proposed modifications include:
o Addition of Outdoor Dining-A new 448 square foot outdoor dining area will be located
to the west of the building and adjacent to an existing 570 square foot outdoor dining
area. The new outdoor dining area brings the total area of outdoor dining to 1,018
square feet. Per the Village Master Plan and Design Manual, no additional parking is
required if the outdoor eating is equal to or less than the amount of indoor seating. The
indoor seating consists of 2,470 square feet. Therefore, no additional parking is required
for the addition of the 448 square feet of outdoor dining area.
o Relocation of Parking Spaces -The new outdoor dining area will be removing two
disabled parking spaces and an eight (8) foot wide loading area. The two disabled
parking spaces and eight (8) foot wide loading area will be relocated to the north and
will replace three standard parking spaces resulting in a loss of three parking spaces. The
parking spaces will not be required to be relocated elsewhere on the property as the net
square footage of the restaurant has decreased from 3,634 square feet to 3,277 square
feet, which requires 33 parking spaces. On-site there are two disabled spaces, 21
standard parking spaces, and 10 additional spaces that can parked through the
operation of valet parking for a total of 33 spaces. A modification to the parking
standards was approved through City Council Resolution No. 2011-254 to allow for the
operation of a valet parking program to satisfy the on-site parking requirements.
Condition No. 15 of said resolution requires the use of valet parking to park vehicles
during weekday and weekend evenings.
In order for a Discretionary Permit Consistency Determination to be approved, all of the following
findings must be made:
1) No project condition, feature, facility or amenity is changed or deleted that had been considered
essential to the project's design, quality, safety or function.
2) The request represents an upgrade in overall design features and or materials and improves
upon the project's compatibility with the surrounding neighborhood.
3} The proposed revision does not change the density or boundary of the subject property.

4} The proposed revision does not involve the addition of a new land use not shown on the original
permit.
5) The proposed revision does not rearrange the major land uses within the development.
6) The proposed revision does not create changes af greater than ten percent provided that
compliance will be maintained with the applicable development standards af the Carlsbad
Municipal Code.
7) The proposed change will not result in any significant environmental impact, and/or require
additional mitigation.
B) The proposed change would nat result in any health, safety or welfare impacts.
9) There were not any major issues or controversies associated with the original project which
would be exacerbated with the proposed change.
10} The proposed change would not be readily discernoble to the decision makers as being
substantially different from the project as originally approved.
After careful consideration of the circumstances surrounding this request, the City Planner has
determined that the application qualifies for a consistency determination with the approved permit and
therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35.
Please submit two (2) blueline copies (24" X 36") of all applicable exhibits (including the most current
revised floor plan) for the project file and a reproducible 24" X 36" mylar copy of the amended site plan.
The mylar must be submitted, stamped "Consistency Determination," and signed by the City Planner
prior to issuance of any building permits for the project. The Consistency Determination Title Block
stamp, and other Title Block stamps, can be downloaded from the City's website at
http://www.carlsbadca.gov/services/departments/planning/Pages/applications.aspx. The Title Block
(stamp) is located under "Resources" on the right side of the page.
