The City ~Janner has completed a review of y0ur application for a Consistency Determination, (APN:
223-050-75-00) which is a modification to the existing Site Development Plan 01-04 for the architecture
and plotting of the commercial building located at the northeasterly corner of Rancho Santa Fe Road
and La Costa Avenue. The proposed modifications include:
• An overall building square footage decreases from 284,400 sq. ft. to 264,579 sq. ft.
• Total number of buildings is reduced from 24 to 22.
• The plotting of Original Building 18 (Grocery) has remained in its approximate original
approved location and renumbered Building 14.
• Building 17 and parking behind has been removed and replaced by Building 15 {25,000
sq. ft.). The Building pad and drive aisle has been moved 15 feet easterly and retaining
walls added to accommodate the pad/building/drive aisle.
• Original Buildings 19 and 23 have been replaced by Buildings 16 and 17. These buildings
form and maintain the central plaza area.
• Original Buildings 20 with 6,000 sq. ft. and Building 21 with 98,000 sq. ft. have been
replaced by Buildings 18, 20 and 25. The two-story department store (Building 21) and
single story Building 20 have been changed to a 40,328 square foot, 29,236 square foot,
and 12,501 square foot single story retail uses (new Buildings 25, 20 and 18
respectively). This is a net increase in floor area of 3,029 square feet for this portion of
the center.
• Building architectural store front heights decrease from 39' to 37' for Building 14 and
from 54' 6"to 47' 2" feet for Building 25.
• The new single story Building 25 extends 85 feet more to the west than the original two-
story building. ·It is also roughly 50 feet more narrow and is 35 feet less deep to the
south and 15 feet less deep from the north than the previous building. The building pad
is also 20 feet lower than the previous plan.
• Original Buildings 22 and 24, financial buildings with drive thru facilities, have both been
deleted from the plan and replaced with parking.
• The site retaining walls have been modified to meet the redesign of the grading due to
building changes.
• The overall provision of parking complies with the requirements of the parking
Ordinance and in conformance with SOP 01-04(A), common parking allowance.

In order for a Discretionary Permit Consistency Determination to be approved, all of the following
findings must be made:
1) No project condition, feature, facility or amenity is changed or deleted that had been considered
essential to the project's design, quality, safety or function.
2) The .request represents an upgrade in overall design features and or materials and improves
upon the project's compatibility with the surrounding neighborhood.
3) The proposed revision does not change the density or boundary of the subject property.
4) The proposed revision does not involve the arfdition of a new land use not shown on the original
permit.
5) The proposed revision does not rearrange the major land uses within the development.
6) The proposed revision does not create changes of greater than ten percent provided that
compliance will be maintained with the applicable development standards of the Carlsbad
Municipal Code.
7) The proposed change will not result in any significant environmental impact, and/or require
additional mitigation.
8) The proposed change would not result in any health, safety or welfare impacts.
9) There were not any major issues or controversies associated with the original project which
would be exacerbated with the proposed change.
10} The proposed change would not be readily discernable to the decision makers as being
substantially different from the project as originally approved.
After careful consideration of the circumstances surrounding this request, the City Planner has
determined that the application qualifies for a consistency determination with the approved permit and
therefore, approves the changes to the project based on Planning Division Administrative Policy No. 35.
Please submit two {2} blueline copies {24" X 36"} of all applicable exhibits for the project file. The plans
must be submitted, stamped "Consistency Determination," and signed by the City Planner prior to
issuance of any building permits for the project. The Consistency Determination Title Block stamp, and
other Title Block stamps, can be downloaded from the City's website at
http:Uwww.carlsbadca.gov/services/departments/planning/Pages/applications.aspx. The Title Block
(stamp) is located under "Resources" on the right side of the page.
