The Property is improved with a 4,500 square foot commercial building (the "Building"). The Building is divided into three tenant spaces. The southernmost space is occupied by Starbucks, the middle space is occupied by Bruegger's Bagels and the northernmost space is currently occupied by Thai Pasta (the "Northern Space"). Contiguous with the Northern Space is a patio area (the "Patio") that has seating with patio furniture. Grant Tucker Properties intends to erect a fence around a portion of the Patio so that beer and wine may be sold out of the Northern Space and consumed on the Patio at some future date, if all necessary approvals are issued to do so. The dimensions of the portion of the Patio to be enclosed would be approximately 15' wide by 40' deep, but not to exceed 600 square feet. The fence would be 36"-42" in height. Although no changes are requested to the Site Plan, Grant Tucker Properties nonetheless requests that the City of Carlsbad find the enclosure of an area of the Patio not to exceed 600 square feet consistent with the SDP for La Costa Plaza. Lot 4 has been improved with a building of 4,500 square feet of leasable space demised into three premises. The southerly space is leased to Starbucks, the center space is leased to Bruegger's Bagels and the northerly space is currently leased to Thai Pasta. There is an existing concrete patio contiguous with the Thai Pasta space which is directly accessible from the Thai Pasta space. Grant Tucker Properties expects to enclose a 600 square foot portion of such patio with a 36" -42" fence so the tenant of the northerly space may serve beer and wine pursuant to all required permits if it so chooses. Although Grant Tucker Properties does not believe further approval of the City of Carlsbad is necessary in order to enclose a portion of the Thai Pasta patio, Grant Tucker Properties nonetheless has decided to seek a Consistency Determination from the City to document its plans to enclose such 600 square foot patio area. We have updated the Site Plan for the Shopping Center to show the location of the enclosed patio area on Lot 4, and the parking provided/required portion of the Site Plan. Accordingly, enclosed please find our Consistency Application and our check in the amount of $733 payable to the City of Carlsbad. We have also enclosed two full sized 40 scale site plans. Finally, we believe all of the findings for a Consistency Determination can be made since there are no changes proposed to the La Costa Plaza Site Plan. The only improvement that is planned is to enclose a 600 square foot portion of the patio adjacent to the northerly space with a 36" - 42" fence colored to match the window mullions of the adjacent restaurant space.
