The consistency determination application must be submitted by appointment*. Please contact the appointment specialist at (760) 602-2723 to schedule an appointment. HOW your application is processed: After a submittal is made, the project planner and project engineer will be assigned the project. Written responses to your submittal will be mailed following the Planning and Land Development Engineering review (and other divisions/departments as applicable) and should be received by you within thirty days after the review date. Please keep in mind that additional information may be requested in order to make a consistency determination and project issues of concern. Upon approval of a Consistency Determination, the City Planner will request the project applicant to submit two (2) blueline copies (24"x36") of all Consistency Determination exhibits to be stamped "Consistency Determination." Also, you may need to provide the City with a reproducible 24"x36" mylar copy of an amended Site Plan which must be stamped "Consistency Determination" to obtain the City Planner's signature. Please review Policy 35 (attached) to determine if your project qualifies for a Consistency Determination. RECf:IVED OCT O 7 2019 CITY OF CARLSBAD PLANNJNG DIVISION P-16 Page 1 of2 Revised 02/28/18 Poinsettia Park-Phase IV Parking Lot and Restroom Consistency Determination Supplemental Information On August 21, 2019, the Planning Commission approved a conditional use permit amendment and coastal development permit for a proposed dog park at Poinsettia Community Park. The next step in the process for the dog park is the City Council's approval of a Master Plan (MP) Amendment. The MP amendment will illustrate the new location of the dog park at the east side of the park. The only remaining development area in the park is a 0.4 acre (approx.) vacant pad located south of the new pickleball courts. Parks staff has identified an opportunity to develop this area with a 39-space parking lot and 2-stall restroom. Approval of a consistency determination for the parking lot and restroom is requested so that these features can be shown on the pending MP amendment. The proposed parking lot would contain 33 standard spaces, 2 ADA spaces, 3 standard electric vehicle (EV) spaces, and 1 van-accessible EV space. Providing the four EV parking spaces is consistent with the requirements of Carlsbad Municipal Code Chapter 18.21.150 California Green Building Standards Code Chapter 5 amended_..:Nonresidential electric vehicle charging. There is also an opportunity to provide a new restroom between the proposed parking lot and the adjacent tennis courts. The restroom would be easily accessible from the upper level tennis courts, pickleball courts, and the proposed dog park. The restroom (approx. 24' x 16') would be designed with two single-user stalls which would provide an unmet need for those that f sir: a 'mily or gender-neutral restroom. 3f:i'f A grading permit will be required for the proposed parking lot, and all supplemental information associated with the grading permit application will be submitted for review and approval. Utilities for the restroom will be included on the civil engineer's plans for the parking lot. A building permit will be required for construction of the restroom, parking lot lighting and EV charging station. Parks staff believes that the parking lot and restroom are uses that are consistent with the Park Master Plan for the following reasons: 1. CMC 21.33.020 Open Space Zone Permitted Uses, identifies parking areas as a permitted use and public restrooms as an accessory use. 2. The proposed improvements do not add a new land use to the Master Plan or increase the maximum anticipated site area or building area for a use by more than twenty percent of the area approved under the p/iffr/a/ Master Plan. Per CMC 21.42.il00.C, the Planning Director can approve the proposed improvements administratively. ~ tfo. Per CMC 21.42.100. Parks, Public. a. All applications for a public park shall include a master park site plan exhibit. The master park site plan exhibit shall include the general location of and maximum anticipated site area and building area of proposed major and accessory park uses (i.e., picnic areas, playfields, playgrounds, athletic fields, swimming pools, tennis/volleyball courts, gymnasiums, clubhouses, restrooms, trails, driveways, parking areas and fences). 0 b. The development of the specific uses that are identified on the master park site plan shall not require an additional conditional use permit or an amendment to the existing master park site plan conditional use permit. c. Park improvements that do not add a new land use to the master park site plan or increase the maximum anticipated site area or building area for a use by more than twenty percent of what is anticipated on the master park site plan may be approved administratively by the city planner. 3. On February 16, 1992, the Coastal Commission approved Coastal Development Permit No. 6-92- 182. The approval included 412 parking spaces and 20,000 square feet of building coverage. The proposed 39-space parking lot would increase the total number of parking spaces to 400. The only buildings in the park are two restrooms with a combined area of approx. 1,565 sf. The proposed restroom will be approximately 385 sf.
