The decision of the Planning Commission became final on January 3, 2001. The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code 1.16. Any petition or other paper seeking judicial review must be filed in the appropriate court not later than the ninetieth day following the date which this decision becomes final; however, if within ten days after the decision becomes final a request for the record of the proceedings accompanied by the required deposit in an amount sufficient to cover the estimated cost of preparation of such record, the time within which such petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one. This preliminary report will be discussed by staff at the Development Coordinating Committee (DCC) meeting which will be held on December 26, 2000. A twenty (20) minute appointment has been set aside for you at 9:00 a.m. If you have any questions concerning your project you should attend the DCC meeting. It is necessary that you bring your required unmounted colored exhibit(s) with you to this meeting in order for your project to go forward to the Planning Commission. City of Carlsbad Public Works — Engineering September 6, 2000 Carolyn LaFrance 3568 Sydney Place San Diego, CA92116 RE: CDP 00-29 TRAUTMAN RESIDENCE The Engineering Department has completed its review of the above referenced project for compliance with the previously determined issues. The project still has issues that must be addressed. The following is a list of these issues: 1. Based on a recent visit to the site, the grading plan does not accurately illustrate the existing topography. A slope that appears to be approximately 6 feet high and at a 40 to 50% grade exists across the front of the property. The grading plan and slope analysis incorrectly shows a uniform 20% slope extending to the curb. Please accurately show the topography. Grading for the driveway will undoubtedly be required at this location in order to establish an acceptable transition to the driveway approach. Show said grading and provide a vertical curve section. The grade transition at the driveway shall be rounded and transition gradually to prevent bottoming of vehicles. Adjust the grading quantities accordingly. Until accurate information is provided, I cannot determine if a grading permit will be required. 2. As I indicated earlier, the driveway may be at an 18% grade provided that the house is protected with a fire sprinkler. The note added to the plan satisfies this issue. However, a separate meter and check valve will be required for the sprinklers. Attached is a detail showing how to design a dual fire and potable water system at the meter. Please incorporate this design on the grading plan. Place one of the meters outside the driveway entrance. Also, indicate with a note that a 30 Ib. Zinc anode with anode lead wire will be installed below the service line. 3. On the grading plan, provide a cross section across the middle of the property extending from the front to the back to illustrate existing grade in relation to the proposed grading. 4. There is a minor inconsistency between the site plan and grading plan where the specimen planter and guest parking are located. The driveway alignment is not consistent nor does the grading plan show a specimen planter. On the site plan, identify the easement information rather than referring to the item number of the title report. As indicated in the letter sent on July 6, 2000, the application is incomplete for processing. The letter also indicates that the engineering department issues and comments will be sent separately. The following are the engineering issues of concern: 1. The maximum driveway grade permissible is 14%. A portion of the driveway ranges in grade from 15% to 18%. In order to reduce the grade, curving the driveway with the existing contours may be necessary. Please redesign accordingly. 2. Revise grades within the City right-of-way to 2%. 3. Relocate the water meter outside the driveway. Please note that water capacity, connection and water meter fees will be colleted at the time of building permit issuance. 4. Provide a cross section of the retaining wall located at the north end of the property. Show the location of the wall's footing and lot line in relation to the wall. A letter of permission to grade may be necessary from the adjacent property owner. 5. Consider providing an area for vehicle turn-around on the driveway, especially if a gate is proposed. I cannot determine if the pilasters and lines shown midway on the driveway is a proposed gate. Please clarify. 6. On the site plan, plot the easements identified under items 13 and 15 of the title report. Attached is a redlined check print of the project for your use in making the requested revisions. The Planning Department has reviewed your Coastal Development Permit, application no. CDP 00-29, as to its completeness for processing. The application is incomplete, as submitted. Attached are two lists. The first list is information which must be submitted to complete your application. This list of items must be submitted directly to your staff planner by appointment. All list items must be submitted simultaneously and a copy of this list must be included with your submittals. No processing of your application can occur until the application is determined to be complete. The second list is issues of concern to staff. When all required materials are submitted the City has 30 days to make a determination of completeness. If the application is determined to be complete, processing for a decision on the application will be initiated. In addition, please note that you have six months from the date the application was initially filed, June 8, 2000, to either resubmit the application or submit the required information. Failure to resubmit the application or to submit the materials necessary to determine your application complete shall be deemed to constitute withdrawal of the application. If an application is withdrawn or deemed withdrawn, a new application must be submitted.
