The Commission voted 6-0 (L'Heureux Absent) to APPROVE your request. The decision of the Planning Commission became final on February 21, 2001. The time within which judicial review of this decision must be sought is governed by Code of Civil Procedure, Section 1094.6, which has been made applicable in the City of Carlsbad by Carlsbad Municipal Code 1.16. Any petition or other paper seeking judicial review must be filed in the appropriate court not later than the ninetieth day following the date which this decision becomes final; however, if within ten days after the decision becomes final a request for the record of the proceedings accompanied by the required deposit in an amount sufficient to cover the estimated cost of preparation of such record, the time within which such petition may be filed in court is extended to not later than the thirtieth day following the date on which the record is either personally delivered or mailed to the party, or his attorney of record, if he has one. However, for this to occur, you must submit the additional items listed below. If the required items are not received by February 1, 2001, your project will be rescheduled for a later hearing. In the event the scheduled hearing date is the last available date for the City to comply with the Permit Streamlining Act, and the required items listed below have not been submitted, the project will be scheduled for denial. 1. Please submit the following plans: A) Ten (10) copies of your site plans, building elevation plans, and floor plans on 24" x 36" sheets of paper, stapled in complete sets folded into 81/2'x11"size. B) One 81/2" x 11" copy of your reduced site plan, building elevation and floor plans. These copies must be of a quality that is photographically reproducible. Only essential data should be included on plans. 2. As required by Section 65091 of the California Government Code, please submit the following information needed for noticing and sign the enclosed form: A) 600' Owners List - a typewritten list of names and addresses of all property owners within a 600 foot radius of the subject property, including the applicant and/or owner. The list shall include the San Diego County Assessor's parcel number from the latest equalized assessment rolls. Engineering staff does not have any comments to add to the project. Please add the following conditions of approval to the approving resolution: Unless specifically stated in the condition, all of the following conditions, upon the approval of this proposed tentative map, must be met prior to approval of a building permit. General 1. Prior to issuance of any building permit, Developer shall comply with the requirements of the City's anti-graffiti program for wall treatments if and when such a program is formally established by the City. 2. Prior to approval of any grading or building permits for this project, Developer shall cause Owner to give written consent to the City Engineer to the annexation of the area shown within the boundaries of the subdivision into the existing City of Carlsbad Street Lighting and Landscaping District No. 1, on a form provided by the City Engineer. Dedications/Improvements 3. Developer shall cause Owner to make an irrevocable offer of dedication to the City and/or other appropriate entities for all public streets and other easements shown on the site plan. The offer shall be made by a separate recorded document. All land so offered shall be offered free and clear of all liens and encumbrances and without cost. The Planning and Engineering Departments have identified several issues of concern with the proposal. These issues, listed below, must be addressed before this application can be scheduled for a hearing. In addition, the City may, in the course of processing the application, request that you clarify, amplify, correct, or otherwise, supplement the basic information required for the application. The maximum allowed area for a Second Dwelling Unit (SOU) is 640 square feet. The proposed floor plan and elevations indicate a 22 foot by 29 foot living area and a 10 foot by 18 foot covered patio area. Since the patio area is covered by a roof, it is counted in the floor area of the SOU. Please revise the floor plans so that the total square footage for the SOU does not exceed 640 square feet covered area. 2. All SDUs require a distinct, off-street parking space (Section 21.10.01 5(c)(3)(G) of the Zoning Ordinance). Please clearly indicate on the site plan the designated parking space for the SOU. If the space is within the existing four-car garage, please indicate which space is reserved for the SOU and show that the minimum dimensions of 12 feet by 20 feet are being satisfied. 3. All SDUs must be architecturally compatible with the main dwelling unit on the property in terms of appearance, materials and finished quality (Section 21.10.01 5(c)(3)(L) of the Zoning Ordinance). Please provide elevations of the existing main dwelling unit, with colors, materials and finish detailed on the plans in order to verify architectural compatibility of the proposed SDU. Engineering: 1. Dedication for public right-of-way will be required along the project frontage prior to issuance of building permit. The ultimate right-of-way width shall be located 10 feet back from the face of curb. Please show the proposed dedication and dimension the width of the dedication on the site plan. 2. Please add the following information on the site plan: a. Clearly show the driveway approach and the location of the driveway on the property. The driveway approach shall be constructed of concrete to the proposed right-of-way boundary (the boundary established after the dedication); b. Please correct the Assessor's Parcel Number to 206-042-01; c. Dimension the existing street centerline to right-of-way width and street centerline to curb width; d. Show the median on Tamarack Avenue; e. Show the location of the existing water meter(s), Pacific Bell pedestal, storm drain inlet, median and any other public facilities located along the project frontage. 3. If a panhandle lot were ever recorded on the property, the driveway leading to the rear lot must be paved. No response or revisions are required by this advisory comment. All items needed for engineering review are provided for determining the application as complete. Engineering issues which need to be resolved or adequately addressed prior to staff making a determination on the proposed project are as follows: 1.
