The purpose of this letter and attached application is to request for an extension of the Carlsbad" Promenade Coastal Development Permit (CDP 00-53x2) and Hillside Development Permit (HDP 00- 10x2). I am submitting this request on behalf of the current owners, North Coast Calvary Chapel, of the Carlsbad Promenade Site located on the northeast corner of Aviara Parkway and Poinsetlia Lane. The extension for the Coastal Development Permit and Hillside Development Permit were approved by the City on April 20, 2005. Due to the 12 month expiration requirement, the CDP and HDP will expire on March 5, 2006. Since the original approval of this project, North Coast Calvary Chapel has been developing a plan to locate a church on this site and received CUP approval on November 17, 2004. ISo CN The purpose of this letter is to request an extension of CDP 00-53x2 and HDP 00-10x2. The intent of this request extension is to maintain the validity of the existing CDP and HDP and the inherent value of existing property entitlements while applying for grading and building permits for the proposed church campus. • lo , "O o D \<J O c u c LU D- I have included the application as required foi this extension. After careful consideration of the circumstances surrounding this request, it has been determined that there has been no change of circumstances in relation to coastal resources per Section 13169 of the California Code of Regulations since the original granting of the permit and that the findings required for granting a Coastal Development Permit can be made and therefore, APPROVES this request based on the following findings and conditions. Findings: 1. That the proposed development is in conformance with the Certified Local Coastal Program and all applicable policies in that the project complies with all applicable requirements of the Mello II Segment of the Local Coastal Program such as policies concerning the conversion of coastal agriculture and environmentally sensitive habitat areas 2. The project complies with the requirements of the Coastal Agricultural Overlay Zone as the project has been conditioned to pay the agricultural conversion mitigation fee to develop the property with uses other than agricultural uses. 3. The project also complies with the requirements of the Coastal Resource Protection Overlay Zone as slopes over 25% containing coastal sage scrub and chaparral are being preserved. Conditions: 1. This Coastal Development Permit extension is valid for a period of one (1) year from the project expiration date of March 5, 2005. If building permits for this project are not obtained within this time period, the coastal development permit extension will expire unless extended per Section 21.201.210 of the Zoning Ordinance. 2. Hofman Planning Associates is submitting this request on behalf of the current owners (North Coast Calvary Chapel) of the Carlsbad Promenade site located on the northeast corner of Aviara Parkway and Poinsettia Lane. The coastal development permit along with a Zone Change (ZC 00-06), Local Coastal Plan Amendment (LCPA 00-08), Carlsbad Tract Map (CT 00-19), and Hillside Development Permit (HDP 00-10) were approved by city council on March 5, 2002. Due to the 24-month expiration requirement, the CDP will expire on March 5, 2004. Since the original approval of this project, North Coast Calvary Chapel (NCCC) has been developing a plan to locate a church on this site. It is anticipated that NCCC will submit to the city within the next month an application for a conditional use permit to allow for the development of a church on this site. The intent of the extension request is to maintain the validity of the existing coastal development permit and the inherent value of the exiting property entitlements during the processing of the conditional use permit. We have also submitted to the Engineering Department a request for an extension to the tentative map.
