Professional Hazard Disclosure ' PhD 1-1-00Page 2 of 5 FLOOD HAZARD AREA The Federal Emergency Management Agency (FEMA) designates areas of flood hazard for the National Flood Insurance Program on Flood Insurance Rate Maps. This Statement identifies whether a property is mapped by FEMA within a 100- year flood area, which is a special flood hazard area under California law. The maps do not necessarily show all areas subject to flooding or all features outside special flood hazard areas. The designation of any area on maps of the National Flood Insurance Program may affect the cost and availability of insurance, requirements regarding flood insurance and financing, and building requirements including the ability to remodel or improve the Property. DAM FAILURE INUNDATION ZONES Dam Failure Inundation Maps from the California Department of Water Resources indicate areas of potential flooding that might result from the catastrophic failure of a dam, dike, or above-ground reservoir. Such inundation can pose serious hazards to properties and inhabitants located downstream from the failure. Failures may result from any of a number of causes, including inappropriate dam design or construction, deterioration of a dam or its foundation, strong ground shaking from an earthquake, surface rupture along a fault, or landsliding. The inundation area mapped is based upon the assumptions that the reservoir is full and that the failure is extremely rapid. As such, this type of dam failure generally is considered unlikely, even though the consequences of this type of failure may be extreme. VERY HIGH FERE HAZARD SEVERITY ZONES Local authorities evaluate and rank Local Responsibility Area (LRA) lands for their potential fire hazard severity. The ranking process considers fuels, topography, dwelling density, and weather. Based on the ranking, Very High Fire Hazard Severity Zones, also known as Bates Zones, are identified and mapped. These zones are delineated on county maps initially, then digitally merged to create a single statewide map. The statewide map is used to prepare this Statement. It is ".. .an approximate representation of the actual locations," according to the State Division of Forestry and Fire Protection. Because the statewide map is approximate, and because it is changed frequently and without notice, it is recommended that the owner of the Property contact the local fire department or agency that issues building permits to determine whether or not the Property is currently within a Very High Fire Severity Zone. The owner of a property within a Very High Fire Severity Zone is subject to the maintenance requirements of Section 51182 of the Government Code. FERE RESPONSIBILITY AREAS These wildland areas, which may contain substantial forest fire risks and hazards, are known as State Responsibility Areas (SRA). The California Department of Forestry and Fire Protection (CDF) defines these lands as follows: "Lands exclusive of cities and federal lands regardless of ownership, classified by the State Board of Forestry as areas in which the primary financial responsibility for preventing and suppressing fires is that of the State. These are lands covered wholly or in part by timber, brush, undergrowth or grass, whether of commercial value or not, which protect the soil from erosion, retard runoff of water or accelerated percolation, and lands used principally for range or forage purposes." Public Resources Code 4236 requires, "A seller of real property which is located within a state responsibility area determined by the board, pursuant to Section 4125, shall disclose to any prospective purchaser the fact that the property is located within Professional Hazard Disclosure PhD 1-1-00 Page 3 of 5 . a wildland area which may contain subsrantial forest fire risks and hazards and is sut to the requirements of Section 4291." It is recommended that the owner of real property in a SRA inquire of the CDF whether or not an agreement exists with a local agency to provide fire protection services to the Property. This statement is intended to disclose fire hazard information in accordance with California law for the purpose of hazard disclosure, not for the purpose of identifying the need for or the cost of fire insurance. ALQUIST-PRIOLO EARTHQUAKE FAULT ZONES The Alquist-Priolo Earthquake Fault Zoning Act was signed into law in 1972, in Public Resources Code Division 2, Chapter 7.5, and has been amended ten times since then. Under that Act, the State Geologist is required to delineate earthquake fault zones along known active faults that meet certain criteria. An active fault is defined as a fault that has had surface displacement during Holocene time (the past 11,000 years). After an area has been designated as an Earthquake Fault Zone under this Act, cities and counties affected by the zone must regulate certain development projects within the zone. With.some exceptions, cities and counties must withhold development permits for sites within the Earthquake Fault Zones until geologic investigations demonstrate that the sites are not threatened by surface rupture from future faulting. If the Property is designated as being in such a zone, it is recommended that a Registered Geologist be retained to conduct a site investigation of the Property in order to determine the locations of faults, if any, on the Property. SEISMIC HAZARDS MAPPING ACT HAZARD ZONES The State of California, Division of Mines and Geology, conducts the Seismic Hazards Mapping Act, pursuant to the California Public Resources Code, Division 2, Chapter 7.8, sections 2690-2699.6, and Chapter 8, Article 10, Sections 3720-3725. A person who is acting as an agent for a transferor of real property which is located within a seismic hazard zone, or the transferor if he or she is acting without an agent, shall disclose to any prospective transferee the fact that the property is located within a seismic hazard zone, if the maps prepared pursuant to this chapter, or the information contained in the maps, are reasonably available. Soil liquefaction occurs when soil is transformed from a wet solid into a liquid by earthquake shaking. Liquefaction causes significant loss of soil strength, and may result in ground settlements, the inability of soil to support structures, ground cracks, and movement of the surface vertically and horizontally. If the Property is designated as being in a liquefaction zone or a landslide zone as designated by the Seismic Hazard Mapping Act, it is recommended that a Registered Geologist or licensed Civil Engineer be retained to conduct a site investigation of the Property. Maps produced for the Seismic Hazard Mapping Act may not show all areas that have the potential for liquefaction or landsliding, or other geologic hazards including strong earthquake motions; as such, it is recommended that a Registered Geologist or licensed Civil Engineer be retained to conduct a site investigation of the Property. SLOPE INSTABILITY If the Property is located on or near a slope, or on hilly or mountainous terrain, it may be impacted by slope instability hazards. If a slope is unstable, the soil, rock, or other materials on the slope may fail, resulting in a landslide. Landslides include mudflows, debris flows, deep rotational slide masses, and small slumps. In addition, erosion of a slope may remove material from the slope, resulting in a slope that is changed and which typically has transported materials deposited near the base of the slope. All are generally part of the process that geologists term mass wasting, which is where earth materials are transported downslope under the influence of gravity. Slope instability may be triggered by any of a number of variables, including slopes saturated by broken water or sewer pipes, landscape irrigation, or rainfall; undercutting of slopes by natural erosion or construction; earthquake shaking; and natural or artificial compaction of unstable ground. Some developments in hilly areas may have been constructed in locations where past landslides have occurred, and where building permit authorities may have records of the development permits, including geologic reports submitted as a part of the permitting process. If the Property is located in hilly terrain, or in an area where there are slopes steeper than a few degrees, it is recommended that a site investigation be conducted by a Certified Engineering Geologist and that the Certified Engineering Geologist obtain and review the permit files, including any geologic reports that may affect the property. In hillside areas, a site investigation by a Certified Engineering Geologist or a licensed Civil Engineer may be required in order to obtain a building permit for new construction or remodeling an existing structure.
