In certain areas, an engineering geology report must also be included. Please consult the City Planning and Engineering Department representative for a determination on any grading plan geotechnical requirements if the project is in an overlay zone. For any address other than single-family residence, an apartment, suite or building number must be included on a separate line. DO NOT include it on the street address line. III. SPECIFIC PROJECT REQUIREMENTS -(May apply to single family, regular and minor coastal development permits). Coastal Overlay Zones require additional information to be submitted as follows: (refer to the Municipal Code for a full description): A. Coastal Agriculture Overlay Zone I. Refer to the Carlsbad Municipal Code Section 21.202.060 for specific requirements. B. Coastal Resource Protection Overlay Zone I. Slope analysis/mapping for 25% and greater subject to Section 21.203.040 of the Carlsbad Municipal Code. 2. Topographic and vegetation mapping/analysis subject to Subsection 21.203.040(B)(l) of the Carlsbad Municipal Code, if project is located along the first row oflots bordering Buena Vista Lagoon including the Lagoon mouth. 3. Topographic, drainage and wetland mapping subject to Subsections 21.203.040(B)(2)(a) and (b) of the Carlsbad Municipal Code if located east of Interstate 5 in the Batiquitos Lagoon watershed. 4. Drainage study subject to Subsection 21.203.040(B)(3) of the Carlsbad Municipal Code if project is located west of existing Paseo del Norte, west of Interstate 5 or along El Camino Real immediately upstream of existing storm drains. 5. Geologic report addressing landslides and slope stability subject to Subsection 21.203.040(B)(4) of the Carlsbad Municipal Code. 6. Geologic report addressing land slides and seismic hazards subject to Subsection 21.203.040(C) and (D) of the Carlsbad Municipal Code. C. Coastal Shoreline Development Overlay Zone I. Geotechnical report subject to 21.204.110 if project is located adjacent to an existing seabluff edge between the sea and the first public road parallel to the sea; also may be required by Planning Director if deemed necessary consistent with Section 21.204.110 of the Carlsbad Municipal Code. 2. Show all structures and decks on adjacent north and south properties to perform "stringline" test subject to Subsection 21.204.050(B) of the Carlsbad Municipal Code. 3. BK ,# ' • Eaton Residence: 12/96 Amilication for Administrative Variance 3/11/97 We have applied for an Administrative Variance to allow us the right to make improvements or to build on this property using the EXISTING side and front yard setbacks. We have received the variance allowing the EXISTING 51 side yard set back. But we have be asked to maintain a 20' front yard set back, when we have an EXISTING 10' set back. We would like to be granted at least the 101 set back for the following reasons: 1. As precedence, and per an Administrative Variance granted to "Weldon Residence" on Oct. 7, 1992. This is a like property 4 lots north of our property, The variance granted 5' side yard setbacks to this undeveloped property. Further, "modification of the front yard setback (was} allowed without an Administrative Variance under Section 21.46.070 of the Municipal Code. Under this section a reduced front yard may allowed by use of a stringline when projects on either side of the subject property have reduced front yards and the property is unimproved. (ours is improved-but the stringline should prove applicable} This section of the code requires that a minimum front yard setback of 8 feet be maintained". '1 .. J.1. 2. As precedence, an Administrative Variance was granted to the immediate '?"-"' neighbor on Nov. 27, 1958; allowing 5' side yard and 10' front yard setbacks. FURTHER: We see no reason for denying us this right since: 1. The exceptional and extraordinary circumstances applicable to the property apply only to particular properties within the vicinity or zone. The existing structure was constructed in it's existing, encroaching location over 40 years ago, with benefit of a valid building permit. The history of the neighborhood shows that it was built before the existence of a municipal code. It would seem that grand fathering would be the accepted method of dealing with applying homes that were built to a building code previous to new code restrictions. 2. We should not be denied the enjoyment of the same substantial property right possessed by the other property in the same vicinity and zone. We see no evidence in the previous building and remodeling in this vicinity that any other property owner in this vicinity has had to comply to a 20 ' front yard setback if the 10' setback existed previously. We would expect that our appeal would not be handled with any prejudice. 3. Because all encroachments are existing, the variance will not be detrimental to public welfare or injurious to the property or improvements in the vicinity or zone. 4. The granting of the variance will not adversely effect the comprehensive General Plan in that use will remain single family, RLM-Residential Low Med. Density, with no circulation impacts. We are asking for a change in the description to Legal Non-Conforming. We purchased this home over 5 years ago. Neither the Title Report nor Disclosure Statement showed any non-compliance, and to my knowledge, it is nowhere a matter of record. Non-Conformance negatively impacts the property value and should be removed. We are applying for the variance without a specific development plan because the variance we are requesting would permit us to build to the existing 10' front yard set back and the existing 5' side yard setback and the existing ocean front string line either now or in the future. We deserve to be granted this right, and that right should be passable to anyone who would purchase this property if we were ever to sell the property. Any and all plans that we submit to the city would be within our existing footprint, observing the height limitations and other restrictions consistent with current •municipal code. The granting of the coastal development permit is greatly appreciated. And I feel the board could have just as easily voted 3 to 2for the variance, instead of the other way, had I been given the chance to speak to the closing comments of two of the members before the vote. which were inaccurate. and based on faulty assumptions. I feel I presented a very accurate and specific case for granting me the Variance of 4' into the I 0-setback.. and I am requesting that I be given a chance to present my case to the Council in a similar manner. My maintaining of over a 20· driveway was deemed most important. but it appeared to get lost in the discussion. The questions and remarks of the Planning Staff. while most were cordial. seemed misstated during "'closing remarks'' made by Julie Baker and Mr. Dominguez. I believe their comments were inaccurate and assumed facts not proven to be so. I was unable to address these comments, as the public comment period was closed, and I feel they unfairly influenced some members, whom I thought were a bit confused, as did others in the room. The final vote took three tries, with comments like. ""remember"', a ""yes" vote is a "'no" vote, and an eventual separation of the two votes by the end. I honestly feel members were confused. I also believe the absence of two senior members of the board, added to the confusion, whom seemed more focused on "proper procedure" that content. by some of the members. I would like to restate my case to the Council. Specific remarks made by Mr. Rodriguez. when I was told to answer ""yes or no". did not allow me any room to explain why I chose to request a variance. rather than try a fifth redesign of the building. I feel that made me look inflexible, which is what he I believe he wanted. since he asked nothing else. He summed up at the end saying words to the effect that. there have been illegal encroachments going on dov.n there for a long time, and it is time we nip it in the bud. Thirty years of encroachments. is far from the bud, the bloom was well off the rose, many times over, with no enforcement. Julie Baker made a summation. which stated that she was "not sure. but she walked by the house and felt that it would be too close to the curb, and ""giving" me an encroachment would mean that they had to give it to everyone down there, and that it was time to hold the line at 1 o•. Is not that the purpose of the board. for them to decide on that. And people. like myself, have to pay for and wait to be heard, which most people are . • - not willing to do. Which may also explain why there are so many encroachments to begin with. The illegal encroachments down there were all around her. Had she looked 50' in either direction, she would have surly noticed a Twall down the sidewalk, just 4 • off the curb to the north, and a building 2 1/2" further towards the curb than mine, which was clearly marked on the notes and plans she was provided. I further feel, with exception of the most willing to offer some assistance, Mr. Montgomery. that the Planning staff was unable to address any effort to help me find a way to get a '"legal'' variance, and upheld the theory that it is better to beg forgiveness that ask permission, which is not the message I felt I would be given by City Officials. Neighbors support, 99.5%, all but I of 20, were in favor of the project, and that "one". not only received a variance, but also built beyond it, and this was discounted. My objection. as well as the neighbor whom spoke on my behalf, a former trial lawyer. (which I heard for the first time at the meeting). made the point that allowing all the numerous(unpermitted) encroachments in the neighborhood were similar to rewarding people who came in the back door. and punishing a person coming in the front door. Not once was there an effort to address this issue. For these reasons and others, I feel there should be a better way to offer a person a '"legal" way to obtain a Variance, where illegal encroachments abound, especially when the only real opposition is from members of the Commission. I am submitting the bullet points of my remarks, to assist the Council. Sincere yours, / _ J •C ~/J t \....P~I Ted Viola 5019 Tierra Del Oro Carlsbad, CA 92008 ' - My proposed structure requests a ")!artial" encroachment of 4-ft. in order to accommodate the offset of two support columns which enter the 10 foot setback at two specific points only, and does not entail the entire building falling 4-ft. within the 10 foot setback. It should also be noted that I am maintaining a driveway length over 20' in both bays, so there will be ample room for a car in the driveway without sticking out into the street. This was the only concern I heard from anyone about an encroachment, and it has been addressed. I would like to point out that this was my fourth "revision" to my original plan, and only asked for this variance out of desperation to save the authentic design of the structure. And while I agree that the building could be redesigned without the columns, which would require using the "minimum" standards for a garage, which is 20'x 20'. Although Staff describes my proposed garage as "oversized'' at a 22' depth, the negative impact of the redesign to minimum standards would be two-fold: First, these two columns support the upper portion of the addition allowing for the 4-ft. offset of that upper portion, which was described as a ··most desirable" feature of the design. Staff has repeatedly noted that at least 5 architectural planes are required. and strongly advises that "all new construction"' in Carlsbad incorporate as many as possible in the design. These new requirements are designed to avoid structures with a "'box-like'" appearance. But with the columns removed, the support for the upper portion shifts to the wall, and the "offset~ of the upper portion is eliminated. Now we have a 25-ft. wall straight up with the only offset being the roofline. The building would still conform to the codes, (due to an abundance of offsets incorporated into the building"s rear), but it would appear ominous. This not only circumvents the code, but now the home loses its' curb appeal. I contend that a design change of this nature would be more offensive to the neighbors as well as the viewing public. Second, the minimum garage standards were designed before mini-vans and SW's ruled the road, and are not practical when you consider a "standard" SW, like a Ford Explorer, which I have, measures just shy of 17ft. Hyou have a 2-ft. standard cabinet, you end up with 9 inches for you to carefully park your car behind the garage door and the wall in front. In summary, I have given you two reasons not to say no to this encroachment of the columns and part of the offset of the garage wall. I would like to give you a few reasons you may not have heard, to say "yes", and approve the request. 1. Facts are that the officials of the City of Carlsbad, the Planning Commission and the neighbors all willingly admit, "in writin~, that encroachments are evident all over this street, as well as the adjoining street called Shore Drive. The fact that the city has not cited, f"med or required removal of these encroachments, is in effect an approval of their existence. The pictures tell the story on their own. 2. I am presenting here the signatures of nineteen neighbors who all live on Tierra Del Oro. I spent weeks meeting them all, and spent hours with several, showing my plans, as well as a color rendition of the finished home. And I answered all manner of personal questions. All in an effort to get their approval that I might- more easily get yours here tonight. It took a tremendous effort to complete. But this is a great collection of people, and I am glad I did it. The appearance of the Clement Family, my bordering neighbor to the south, and Steve Moss, bordering north, (who regrets he could not appear here tonight since he stuck in LA), both offered personal letters of support. This represents all but one person in the hospital, one abstention, and one whom you may hear from tonight. I ask you to see my efforts, my due diligence and my willingness to wait month., for this momen~ and at great expense, to get your "legal" approval to do what has been done illegally all around this area for years, without reprisal. I am asking for permission, as I asked all my neighbors, several of whom knowingly took and already enjoy this privilege of an encroachment into the setback and feel I should too. All the neighbors agree, that this home will look great here, and all will benefit from it in the long run. Dear Planning Director, -- After further research and discovery, I respectfully submit a revised request for permission to receive an Administrative Variance in regards to the proposed redevelopment of 5019 Tierra Del Oro Street. This property is one of only twelve single- family residences on the oceanfront of this private cul-de-sac in Carlsbad. Although the legal lot size of this property is described as 14,300 square feet or 60-ft (street/beach) frontage by 230.9 ft to the median tide line, the buildable area is substantially limited by standard front yard and bluff setbacks due to erosion. This limits the buildable area, in my case, to less than 50 ft. by 60 ft, or around 20% of the property, which must also include garage space, (non-habitable), and driveway parking, as well as "offsets" to provide at least 5 different planes of construction. My proposed structure requests a "partial" encroachment of 4-ft. in the "two-car" portion of the garage only, which would be consistent with other variances granted on the same block, (see attached copy of AV 96-07 at 5025 Tierra del Oro Street), located two properties south. Although AV 96-07 does not specifically state "how far" the property owner may encroach into the front yard setback, their survey pins clearly indicate an encroachment ofat least 2-ft. beyond the 10-ft. setback mark. all other "visible" survey pins marking property lines throughout this cul-de-sac appear to fall in generally in the same spot within the rolled curb. This variance would grant me the same substantial property rights possessed by others on the bluff who are not so limited by the bluff erosion, as are these properties, so as to allow for adequate ground floor living space. It would also maintain the architectural articulation across the building frontage, which staff commented is a "positive feature" of the design, and prefer we maintain. Please consider the fact that this cul-de-sac currently has "various and numerous encroachments", many of which have been in place for many years, but no city records can be found to support them or to support my case for a variance request. I have also provided the "picture book" bound with almost twenty examples of encroachments in the area to support my request, as suggested by staff. Also, the entrance is clearly marked with a sign stating "no beach access", and seldom r C has any off-street cars parked on it. The street is a very wide cul-de-sac, (sixty feet), with a rolled curb, no sidewalks, and most front yards planted right to the street with trees and bushes. Granting this variance should not impact the public line of sight or right to pass, not already encumbered. And finally, please consider that I do not intend to perform any grading or underground excavation. I respectfully request this variance as a better alternative, as it may assist the City and Coastal Commission in preserving the remaining bluff, foregoing it as a means to gain much desired underground living space, more prevalent in new area construction. This variance means a great deal to the design and usability of the floor plan.
