HomeMy WebLinkAboutCDP 05-14; DKN Hotel; Coastal Development Permit (CDP)• 0 CITY OF CARLSBAD APPLICATION REQUIREMENTS FOR: COASTAL DEVELOPMENT PERMIT (SINGLE FAMILY REGULAR AND MINOR) COASTAL DEVELOPMENT PERMIT SUPPLEMENTAL APPLICATION (FOR ALL COASTAL DEVELOPMENT PERMITS) This supplemental application is to be filed for any development requiring a Coastal Development Permit issued by the City of Carlsbad. **Application checklist for Non-Single Family Regular Coastal Development Permits covered under separate handout. A proposed project requiring that multiple applications be filed must be submitted prior to 3:30 p.m. A proposed project requiring that only one application be filed must be submitted prior to 4:00 p.m. All joint application exhibits, i.e. Tentative Map and Planned Development Site Plan should be prepared at the same scale. (Use a scale no smaller than 1" = 40' .) This supplemental application is to be filed for any development requiring a Coastal Development Permit issued by the City of Carlsbad. I. GENERALBACKGROUND A. Estimated Cost of Development: Development costing $60,000 or more does not qualify as a Minor Coastal Development Permit. The Planning Director shall make the final determination regarding a project's cost of development. The primary basis for determining cost of development will be the application of dollar costs per square foot for different types of residential construction. These costs are set by the International Conference of Building Officials (ICBO) and are applied throughout San Diego County. Please complete the following information to assist in the determination of this project's cost of development (Contractor proposals may also· be submitted for consideration by the Planning Director). Please refer to the currentfee schedule for the appropriate $/square foot fee rate. The project originally received Planning Commission approval on March 7, 2007, subsequent LCPA approval by the California Coastal Commission on August 7, 2008, an extension by the City Planner on August 5, 2010 and is due to expire on August 7, 2012. After careful consideration of the circumstances surrounding this request, it has been determined that (1) there has been no change of circumstances in relation to coastal resources per Section 13169 of the California Code of Regulations, (2) the project is still in compliance with the Coastal Development Permit regulations, and (3) that the findings required for granting a Coastal Development Permit retroactive extension can be made; therefore, the City Planner APPROVES Coastal Development Permit Extension No. COP 05-14x2 for 2 years (from August 8, 2012 to August 8, 2014), to coincide with the Site Development Plan 05-04x2, based on the following findings and conditions. Findings: 1. All of the findings contained in the Planning Commission Resolution No. 6258 dated March 7, 2007 for COP 05-14 apply to this extension and are incorporated herein by reference and remain in effect. 2. That the 2-year extension (from August 8, 2012 to August 8, 2014) is appropriate because the owner/applicant is diligently pursuing finalizing all necessary permits, the project is still consistent with the Coastal Development Permit regulations, and the extension would allow the owner/applicant to preserve existing property entitlements while satisfying the conditions for the construction of a 3-story, 104-room hotel on .84 acres of land (COP 05-14). 3. That such permits and approvals as extended are consistent with the requirements of Title 21 of this code at the time of their extension. 4. The project has been reviewed pursuant to the California Environmental Quality Act (CEQA). The City Planner has determined that the potential environmental effects of the project were adequately analyzed by the previously adopted Negative Declaration for SDP 05-04/RP 05- 03/CDP 05-14.
