HomeMy WebLinkAboutCDP 05-14x1; DKN Hotel; Coastal Development Permit (CDP)V CARLSBAD Planning Division www.carlsbadca.gov Augusts, 2010 DKN Hotels 540 Golden Circle Drive #214 Santa Ana, CA 92705 SUBJECT: CDP 05-14x1 - DKN HOTEL The- Planning Department has completed a review of your application for a Coastal Development Permit Extension, CDP 05-14x1 - DKN HOTEL, located at 3136 Carlsbad Blvd. The project consists of the demolition of an existing hotel, restaurant, and single family residence and for the construction of a 3-story, 104-room hotel on .84 acres of land. The project originally received Planning Commission approval on March 7, 2007 and subsequent LCPA approval by the California Coastal Commission on August 7, 2008 and is due to expire on August 7, 2010. After careful consideration of the circumstances surrounding this request, it has been determined that (1) there has been no change of circumstances in relation to coastal resources per Section 13169 of the California Code of Regulations, (2) the project is still in compliance with the Coastal Development Permit regulations, and (3) that the findings required for granting a Coastal Development Permit extension can be made; therefore, the City Planner APPROVES Coastal Development Permit Extension No. CDP 05-14x1 for 2 years (from August 8, 2010 to August 8, 2012), to coincide with the Site Development Plan 05-04x1, based on the following findings and conditions. Findings: 1. All of the findings contained in the Planning Commission Resolution No. 6258 dated March 7, 2007 for CDP 05-14 apply to this extension and are incorporated herein by reference and remain in effect. 2. That the 2-year extension (from August 8, 2010 to August 8, 2012) is appropriate because the owner/applicant is diligently pursuing finalizing all necessary permits, the project is still consistent with the Coastal Development Permit regulations, and the extension would allow the owner/applicant to preserve existing property entitlements while satisfying the conditions for the construction of a 3-story, 104-room hotel on .84 acres of land (CDP 05-14). 3. That such permits and approvals as extended are consistent with the requirements of Title 21 of this code at the time of their extension. 4. The project has been reviewed pursuant to the California Environmental Quality Act (CEQA). C. Augusts, 2010 Page 2 Conditions: 1. This Coastal Development Permit extension is granted from August 8, 2010 to August 8, 2012. If building permits for this project are not obtained within this time period, the coastal development permit extension will expire on August 8, 2012, unless extended per Section 21.201.210 of the Carlsbad Municipal Code. 2. All of the conditions contained in Planning Commission Resolution No. 6258 dated March 7, 2007 for CDP 05-14 apply to this extension and are incorporated herein by reference and remain in effect except for Planning Condition No. 7 which is superseded by Condition No. 1 of this approval letter.
