This supplemental application is to be filed for any development requiring a Coastal Development Permit
issued by the City of Carlsbad.
**Application checklist for Non-Single Family Regular Coastal Development Permits covered under

A proposed project requiring that multiple applications be filed must be submitted prior to 3:30 p.m. A
proposed project requiring that only one application be filed must be submitted prior to 4:00 p.m.
All joint application exhibits, i.e. Tentative Map and Planned Development Site Plan should be prepared at the
same scale. (Use a scale no smaller than I"= 40' .)
This supplemental application is to be filed for any development requiring a Coastal Development Permit
issued by the City of Carlsbad.
I. GENERAL BACKGROUND
A. Estimated Cost of Development:
Development costing $60,000 or more does not qualify as a Minor Coastal Development
Permit. The Planning Director shall make the final determination regarding a project's cost of
development.
The primary basis for determining cost of development will be the application of dollar costs
per square foot for different types of residential construction. These costs are set by the
International Conference of Building Officials (ICBO) and are applied throughout San Diego
County.

of development (Contractor proposals may also be submitted for consideration by the

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN to you that the Planning Commission of the City of Carlsbad will hold a
public hearing at the Council Chambers, 1200 Carlsbad Village Drive, Carlsbad, California, at 6:00
p.m. on Wednesday, March 5, 2008, to consider a request for the following:

DESCRIPTION: Request for approval of a Coastal Development Permit to allow for the
construction of a 3,200 square foot single family residence within the City's Coastal Zone located at
4015 Sunnyhill Drive within the Mello II Local Coastal Program Segment and Local Facilities
Management Zone 1.

Development Permit within your neighborhood has been submitted to the City of
Carlsbad on May 7, 2007. The project application is undergoing its initial review by the

Land Development Engineering (LDE) has completed its review of the above referenced project.
LDE has no comments. Please add the conditions of approval shown below to the approving
resolution or letter:
Engineering conditions of approval:
1. Developer shall complete and submit to the city engineer a Project Threat Assessment
Form {PTAF) pursuant to City Engineering Standards. Concurrent with the PTAF,
developer shall also submit the appropriate Tier level Storm Water Compliance form
and appropriate Tier level Storm Water Pollution Prevention Plan {SWPPP) as
determined by the completed PTAF all to the satisfaction of the city engineer. Developer
shall pay all applicable SWPPP plan review and inspection fees per the city's latest fee
schedule.
2. Developer shall comply with the City's Stormwater Regulations, latest version, and shall
implement best management practices at all times. Best management practices include
but are not limited to pollution treatment practices or devices, general housekeeping
practices, pollution prevention and educational practices, maintenance procedures, and
other management practices or devices to prevent or reduce the discharge of pollutants
to stormwater, receiving water or stormwater conveyance system to the maximum
extent practicable. Developer shall notify prospective owners and tenants of the above
requirements.

The Engineering Department has completed its review of the above referenced project for
compliance with the previously determined issues. The project appears to comply with City
engineering standards and all issues have been addressed. Please add the following conditions of
approval to the approving resolution or letter: '
ENGINEERING CONDITIONS
NOTE: Unless specifically stated in the condition, all of the following conditions, upon
the approval of this proposed development, must be met prior to approval of a grading permit,
whichever occurs first).
General
1. Prior to hauling dirt or construction materials to or from any proposed construction site
within this project, Developer shall apply for and obtain approval from, the City Engineer
for the proposed haul route.
2 Subject to the City Engineer's approval, the property owner' shall apply for and
obtain an encroachment agreement with the City to allow the existing trees/shrubs
and concrete walkway pavers located in the Sunnyhill Drive public right-of-way to
remain. Otherwise, said trees/shrubs and concrete walkway pavers or portion
thereof shall be removed as determined by the City Engineer.
3. The planter strip between the proposed driveway and the existing driveway serving
4001 and 4005 Sunnyhill Drive shall be no less than 3 feet wide.
Fees/ Agreements
4. Developer shall cause property owner to execute and submit to the City Engineer for
recordation the City's standard form Drainage Hold Harmless Agreement regarding

drainage across the adjacent property.
5. Developer shall cause property owner to execute, and submit to the City .Engineer for
recordation, a deed restriction on the property which relates to the proposed cross lot
drainage as shown on the site plan. The deed restriction document shall:
A. Clearly delineate the limits of the drainage course;
B. State that the drainage course is to be maintained in perpetuity by the underlying
property owner; and
C. State that all future use of the property along the drainage course will not restrict,
impede, divert or otherwise alter drainage flows in a manner that will result in
damage to the underlying and adjacent properties or the creation of a public
nmsance.
6. Developer shall cause property owner to enter into a Neighborhood Improvement
Agreement with the City on a City Standard form for the future public improvement of
Sunnyhill Drive along the subdivision frontage for a half street width of 30 feet. Public
improvements shall include but are not limited to paving, base, sidewalk, curb and gutter,
grading, clearing and grubbing, undergrounding or relocation of utilities, fire hydrants,
and street lights.
7. Prior to approval of any grading or building permits for this project, Developer shall
cause Owner to give written consent to the City Engineer for the annexation of the area
shown within the boundaries of the site plan into the existing City of Carlsbad Street
Lighting and Landscaping District No. 1 and/or to the formation or annexation into an
additional Street Lighting and Landscaping District. Said written consent shall be on a
form provided by the City Engineer.
8. Developer shall install sight distance corridors at the driveway in accordance with City
Engineering Standards. Said site distance shall be shown on the grading plan.
Grading
9. Based upon a review of the proposed grading and the grading quantities shown on the site
plan, a grading permit for this project is required. Developer shall apply for and obtain a
grading permit from the City Engineer prior to issuance of a building permit.
10. Developer shall comply with the City's requirements of the National Pollutant Discharge
Elimination System (NPDES) permit and the City's Standard, Urban Storm Water
Mitigation Plan (SUSMP). Developer shall provide improvements constructed pursuant to
best management practices as referenced in the "California Storm Water Best
Management Practices Handbook" to reduce surface pollutants to an acceptable level
prior to discharge to sensitive areas. Plans for such improvements shall be submitted to
and subject to the approval of the City Engineer. Said plans shall include but not be
limited to notifying prospective owners and tenants of the following:

A. All owners and tenants shall coordinate efforts to est)lblish or work with
established disposal programs to remove and properly dispose of toxic and
hazardous waste products.
B. Toxic chemicals or hydrocarbon compounds such as gasoline, motor oil,
antifreeze, solvents, paints, paint thinners, wood preservatives, and other such
fluids shall not be discharged into any street, public or private, or into storm drain
or storm water conveyance systems. Use and disposal of pesticides, fungicides,
herbicides, insecticides, fertilizers and other such chemical treatments shall meet
Federal, State, County and City requirements as prescribed in their respective
containers.
C. Best Management Practices shall be used to eliminate or reduce surface pollutants
when planning any changes to the landscaping and surface improvements.
11. Developer shall cause property owner to process, execute and submit an executed copy
to the City Engineer for recordation a City standard Permanent Stormwater Quality Best
Management Practice Maintenance Agreement for the perpetual maintenance of all
treatment control, applicable site design and source control, post-construction permanent
Best Management Practices prior to the issuance of a grading permit or building permit,
or the recordation of a parcel map, whichever occurs first for this Project.
12. Developer shall have the entire drainage system designed, submitted to and approved by
the City Engineer, to ensure that runoff resulting from 1 0-year frequency storms of 6
hours and 24 hours duration under developed conditions, are equal to or less than the
runoff from a storm of the same frequency and duration under existing developed
conditions. Both 6 hour and 24 hour storm durations shall be analyzed to determine the
detention basin capacities necessary to accomplish the desired results.
Dedications/Improvements
13. Developer shall provide the design of all private drainage system!> to the satisfaction of
the City Engineer. All private drainage systems shall be inspected by the City.
14. Developer shall execute a City standard development improvement agreement to install
and secure with appropriate security as provided by law, public sewer improvements
shown on the site plan. Said improvements shall be installed to City Standards to the
satisfaction of the City Engineer. More specifically, these improvements include:
a) Adding a sewer lateral and extending a sewer main in Sunnyhill Drive northerly
from its existing terminus located southeast of the property.
b) Adding a water service from the property line to the public street main.
Improvements listed above shall be constructed within 18 months of approval of the
development improvement agreement or such other time as provided in said agreement.

Utilities
15. Prior to issuance of building permits, Developer shall pay all fees, deposits, and charges
for connection to public facilities.
16. The Developer shall install potable water services and meters at locations approved by the
District Engineer. The locations of said services shall be reflected on public improvement
plans.
17. The Developer shall install sewer laterals and clean-outs at locations approved by the
District Engineer. The locations of sewer laterals shall be reflected on public
improvement plans.
18. The Developer shall design and construct public water and sewer facilities substantially
as shown on the Site Plan to the satisfaction of the District Engineer.

Engineering Department staff has completed a review of the above-referenced project for application
completeness. The application and plans submitted for this proposed project are currently incomplete
and unsuitable for further review due to the following incomplete items:
1. Completed Stormwater Requirement Applicability Checklist. This checklist can be printed from

The following issues need to be resolved prior to resubmittal:
1. On the site plan, plot the:
a) City easement identified as "egress and ingress" per Item No. 13 of the preliminary title report.
The title report states that the exact location is not disclosed but this ~tatement as incorrect. A
legal description and plat of the easement is provided as an attachment to the deed. Also, the
deed describes many uses other than ingress and egress. A more appropriate description would
be a "general" utility easement.
b) Private Road and Utility Easement described under Item 8 of the Preliminary Title Report.
2. Remove the proposed sidewalk on Sunnyhill Drive since this street is designated as an alternative
design street. Current standards require that the developer prepare a sidewalk design for the
entire block to be decided by the City Council with neighborhood workshops and input OR the
property owner may enter into a Neighborhood Improvement Agreement (NIA) with the City in
lieu of preparing a design for the block. Because a Contract for Future Public Improvements has
already been recorded between a previous owner and the City, this document is an acceptable
alternative to recording an NIA.
3. Several property line bearings vary by several minutes between the site plan and recorded
adjustment plat (ADJ 02-07). Also, the recorded adjustment plat labels the area of the subject lot
as 15,611 square feet. The site plan shows 15,895 square feet. Please provide your source for the
property line dimensions and bearings and correct discrepancy as neede<!·
4. On the site plan:
a) Screen the existing contour, hedge, structure, etc. lines to clearly delineate between existing

b) It is unclear where the 300 cubic yards of fill is proposed. Use proposed spot elevations,

d) Label driveway material. Driveway shall be constructed of AC within the right-of-way.

e) Indicate that the tree in the driveway will be removed.
f) Plot nearest fire hydrant.
g) Provide dimensioned street cross section.
5. How will the increase in drainage runoff be handled due to the proposed impervious surfaces
created by the house and driveway? Provide a drainage study from a registered engineer which
analyzes potential downstream impacts and provides solutions to such impacts. Show, on the site
plan, how any design modifications needed to treat increased runoff or concentration of drainage
will be incorporated to prevent any downstream flooding, scouring, etc.
6. Clearly label the boundaries of the proposed driveway. It appears that curbs (double solid lines)
are proposed. Are these curbs? Also, provide a scaled vertical profile of the driveway with
grades at the transitions. Provide vertical curves where grade breaks exceed 5%. Also, show how
drainage will flow on the driveway and how it will be diverted from the garage entranceway.
Plot passenger vehicle turning movement per CALTRANS standards. Will the vehicle backing
out of the garage need to use the neighbor's driveway to make the necessary turn? If so,
permission will be needed from the neighbor in the form of an easement.
The owner has stated that he may want to share the existing offsite driveway to the north instead
of building a new onsite driveway. I suggest that you provide alternative plan(s) showing this
design and how joint access rights will be secured so that the City Planning Commission can
decide on this alternative.
7. The grades in the front yard are either created by fill or if this grade exists, then cut must be
proposed at the pad. Either way, to create the grades shown in addition to the grading needed to
create the driveway, it appears that more than 300 feet of fill is needed. Please clarify.
8. Indicate if the 5-foot diameter pine tree in the public right-of-way will remain or be removed. If
removed, separate permission from the Parks Department will be required.
9. Plot on-site water and sewer utilities and street utilities. Show that sewer gravity flow can be
obtained or indicate that a sewer pump will be used if gravity is not i.Jossible. Also, plot the
water main extending between the cul-de-sac on Alder Avenue and Sunnyhill Drive.
10. Is the sewer access hole plotted correctly? It appears to be misaligned from the centerline of the
street, where it would normally be located. Please recheck and verify.
11. Remove the circular driveway from sheet A.2. There is no second driveway proposed according
to the site plan.
12. The existing pavers identified as a sidewalk on the site plan either need to be removed or an
encroachment agreement needs to be processed with the City. The same comment applies to the
hedges if they are in the right-of-way.

The Planning Department has completed a review of your application for a Coastal
Development Permit Extension, COP 07-12x1 -SEARS RESIDENCE, located at 4015
Sunnyhill Drive. The project consists of a 3,200 square foot residence on a .36 acre lot. The
project originally received approval of a Coastal Development Permit on March 5, 2008 and is
due to expire on March 4, 2010. After careful consideration of the circumstances surrounding
this request, it has been determined that (1) there has been no change of circumstances in
relation to coastal resources per Section 13169 of the California Code of Regulations, (2) the
project is still in compliance with the Coastal Development Permit regulations, and (3) that the
findings required for granting a Coastal Development Permit extension can be made; the·refore,
the Planning Director APPROVES Coastal Development Permit Extension No. COP 07 -12x1
for 1 year (from March 5, 2010 to March 4, 2011) based on the following findings and
conditions.
Findings:
1. All of the findings contained in the Planning Commission Resolution No. 6400 dated
March 5, 2008 for COP 07-12 are incorporated herein by reference and remain in effect.
2. That the 1-year extension (from March 5, 2010 to March 4, 2011) is appropriate
because the owner/applicant is diligently pursuing finalizing all necessary permits, the
project is still consistent with the Coastal Development Permit regulations, and the
extension would allow the owner/applicant to preserve existing property entitlements
while satisfying the conditions for the construction of a new 3,200 square foot single-
family residence on a .36 acre lot (COP 07-12).
3. That such permits and approvals as extended are consistent with the requirements of
Title 21 of this code at the time of their extension.
4. The Planning Director has determined that the project belongs to a class of projects that
the State Secretary, of Resources has found do not have a significant impact on the
environment, and it is therefore categorically exempt from the requirement for the
preparation of environmental documents pursuant to State CEQA Guidelines Section
15303(a) which exempts the construction of single-family residence in an urbanized
area.

Conditions:

1. This Coastal Development Permit extension is granted from March 5, 201 0 to March
4, 2011. If building permits for this project are not obtained within this time period, the
coastal development permit extension will expire on March 5, 2011, unless extended
per Section 21.201.210 of the Carlsbad Municipal Code. ·
2. All of the conditions contained in Planning Commission Resolution No. 6400 dated
March 5, 2008 for COP 07-12 are incorporated herein by reference and remain in effect
except for Planning Condition No. 11 which is superseded by Condition No. 1 of
this approval letter and Condition No. 13 which is superseded by Condition No. 3
of this approval letter.
3. Prior to Building Permit issuance, the Developer shall submit to the City a Notice of
Restriction executed by the owner of the real property to be developed. Said notice is to
be filed in the office of the County Recorder, subject to the satisfaction of the Planning
Director, notifying all interested parties and successors in interest that the City of
Carlsbad has issued a Coastal Development Permit Extension by this Approval
Letter, dated March 1, 2010 on the property. Said Notice of Restriction shall note the
property description, location of the file containing complete project details and all
conditions of approval as well as any conditions or restrictions specified for inclusion in
the Notice of Restriction. The Planning Director has the authority to execute and record
an amendment to the notice which modifies or terminates said notice upon a showing of
good cause by the Developer or successor in interest.

I am requesting your approval of a side yard swap per Carlsbad Municipal Code Section
21.10.070. for the proposed property.
4015 Sunnyhill Dr., zoning (R-1-15000), approved CDP # (CDP 07-12)
The setback would normally be 1 0 feet on each side. I am proposing to have a small
portion of the house at a 7 foot setback on one side, while the opposite would have at
least 13 feet to make up for the 3 foot reduction. Due to the irregular shape of the lot,
most of the house would be at or over the normal 1 0 foot setback line. The proposed
reduced side yard is not less than 5 feet in width nor abutting a lot with an adjacent
reduced side yard and the increased side yard is larger than 10 feet. This complies with
21.10.070 A. 1. b. Additionally the house was not shifted further to the other side in order
to have a usable side yard without removing driveway access from neighbors even
though a portion of the driveway is located on my property. By shifting the side yard
allows me the necessary clearance for an additional parking space. Although the
approved CDP plans show the house fitting within the normal 10 foot setbacks, after
reviewing 21.10.070 A. 1. b I directed Bob Sukup, The Sea Bright Co., to make the
change on the grading plan .
