HomeMy WebLinkAboutCDP 07-12x3; Sears Residence; Coastal Development Permit (CDP)CITY OF V (CARLSBAD Community & Economic Development www.carlsbadca.gov April 17, 2013 Tom Sears 1387 Cynthia Lane Carlsbad, CA 92008 SUBJECT: CDP 07-12x3 - SEARS RESIDENCE The Planning Division has completed a review of your application for a Coastal Development Permit Extension, CDP 07-12x3 - SEARS RESIDENCE, located at 4015 Sunnyhill Drive. The project consists of a 3,200 square foot residence on a .36 acre lot. The project originally received approval of a Coastal Development Permit on March 5, 2008 and, after two subsequent extensions, was due to expire on March 4, 2013. However, an application was filed to extend the Coastal Development Permit prior to the expiration. After careful consideration of the circumstances surrounding this request, it has been determined that (1) there has been no change of circumstances in relation to coastal resources per Section 13169 of the California Code of Regulations, (2) the project is still in compliance with the Coastal Development Permit regulations, and (3) that the findings required for granting a Coastal Development Permit extension can be made; therefore, the City Planner APPROVES Coastal Development Permit Extension No. CDP 07-12x3 for two (2) years (from March 5, 2013 to March 4, 2015) based on the following findings and conditions. Findings: 1. All of the findings contained in the Planning Commission Resolution No. 6400 dated March 5, 2008 for CDP 07-12, are incorporated herein by reference and remain in effect. 2. That the two (2) year extension (from March 5, 2013 to March 4, 2015) is appropriate because the owner/applicant is diligently pursuing finalizing all necessary permits, the project is still consistent with the Coastal Development Permit regulations, and the extension would allow the owner/applicant to preserve existing property entitlements while satisfying the conditions for the construction of a new 3,200 square foot single-family residence on a .36 acre lot (CDP 07- 12). 3. That such permit and approval as extended are consistent with the requirements of Title 21 of this code at the time of their extension. 4. The City Planner has determined that the project belongs to a class of projects that the State Secretary of Resources has found do not have a significant impact on the environment, and it is therefore categorically exempt from the requirement for the preparation of environmental documents pursuant to State CEQA Guidelines Section 15303(a) which exempts the construction of single-family residence in an urbanized area. This Coastal Development Permit extension is granted retroactively from March 5, 2013 to March 4, 2015. If building permits for this project are not obtained within this time period, the coastal development permit extension will expire on March 5, 2015, unless extended per Section 21.201.210 of the Carlsbad Municipal Code. 2. All of the conditions contained in Planning Commission Resolution No. 6400, dated March 5, 2008 for CDP 07-12, are incorporated herein by reference and remain in effect except for Planning Condition No. 11 which is superseded by Condition No. 1 ofthis approval letter. 3. Fire sprinklers will be required for the project per the 2010 California Fire Code.
