HomeMy WebLinkAboutCDP 07-31x1; Hosp Grove Park Access Road; Coastal Development Permit (CDP)*, ni V CARLSBAD Planning Division www.carlsbadca.gov August 18, 2010 Jon Schauble Associate Engineer Transportation Department 1635 Faraday Avenue Carlsbad, CA 92008 SUBJECT: CDP 07-31x1 - HOSP PARK DRAINAGE IMPROVEMENTS The Planning Department has completed a review of your application for a Minor Coastal Development Permit Extension, CDP 07-31X1 - HOSP PARK DRAINAGE IMPROVEMENTS, located at the southwest corner of Jefferson Street and Marron Road. The project consists of the removal of the AC material on the existing access road and replacing the AC material with stamped concrete and installing a rip rap energy dissipater at the northern end of the AC access road. The project originally received City Planner approval on May 8, 2008, and expired on May 8, 2010. The access road also functions as a drainage channel and will convey runoff into the proposed dissipater. After careful consideration of the circumstances surrounding this request, it has been determined that (1) there has been no change of circumstances in relation to coastal resources per Section 13169 of the California Code of Regulations, (2) the project is still in compliance with the Minor Coastal Development Permit regulations, and (3) that the findings required for granting a Minor Coastal Development Permit extension can be made; therefore, the City Planner retroactively APPROVES Minor Coastal Development Permit Extension No. CDP 07-31x1 for one year (retroactively from May 8, 2010 to May 8, 2011), based on the following findings and conditions. Findings: 1. All of the findings contained in the City Planner's approval letter dated May 8, 2008 for CDP 07-31 apply to this extension and are incorporated herein by reference and remain in effect. . 2. That the retroactive one year extension is appropriate because the owner/applicant is diligently pursuing finalizing all necessary permits, the project is still consistent with the Minor Coastal Development Permit regulations, and the extension would allow the owner/applicant to preserve existing property entitlements while satisfying the conditions for replacing the AC material with stamped concrete, and installing a rip rap energy dissipator at the northern end of the AC access road (CDP 07-31). 3. That such permit and approval as extended are consistent with the requirements of Title 21 of this code at the time of their extension. That the Planning Director has determined that the project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15301(b) Existing Facilities of the State CEQA Guidelines because the drainage channel improvements will not have any adverse significant impact on the environment. The drainage channel improvements will direct storm water runoff into an existing natural drainage channel, which will reduce erosion in the park. Conditions: 1. This Minor Coastal Development Permit extension is granted retroactively from May 8, 2010 to May 8, 2011. If building permits for this project are not obtained within this time period, the coastal development permit extension will expire on May 8, 2011, unless extended per Section 21.201.210 of the Carlsbad Municipal Code. 2. All of the conditions contained in the City Planner's approval letter dated May 8, 2008 for CDP 07-31 apply to this extension and are incorporated herein by reference and remain in effect except for Condition No. 5 which is superseded by Condition No. 1 of this approval letter, and Condition No. 8 which is no longer applicable since the project has been reduced in scope and no work will occur within the natural drainage channel.
