In certain areas, an engineering geology report must also be included. Please consult the Planning Division and Land Development Engineering Division representatives for a determination on any grading plan geotechnical requirements if the project is in an overiay zone. The following information shall be submitted at a minimum: •l. Approximate contours at 1' intervals for slopes less than 5%; 2' intervals for slopes between 5% and 10%; and 5' intervals for slopes over 10% (both existing and proposed). Existing and proposed topographic contours within a 100-foot perimeter of the boundaries of the site. Extend contours sufficiently out from the site to adequately show the adjacent floodplain (if applicable). •2. Earthwork volumes: cut, fill, import and export. •3. Spot elevations at the corners of each pad. •4. Method of draining each lot. Include a typical cross section taken parallel to the frontage for lots with less than standard frontage. •5. That the proposed development is consistent with Section 21.10.030 ofthe Carlsbad Municipal Code (C.M.C). 3. That the proposed development is in conformance with the Mello II Segment of the Certified Local Coastal Program and all applicable policies in that the development consists of a new second dwelling unit and the development is consistent with the Mello II Land Use designation of RH. The proposed second dwelling unit located above a detached garage is consistent with the surrounding development of one-story and two-story single-family structures. The second dwelling unit will not obstruct views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are there any sensitive resources located on the property. The proposed second dwelling unit, is not located in an area of known geologic instability or flood hazard. The site is located in close proximity to the coast but no public opportunities for coastal shoreline access are available from the subject site. The residentially designated site is not suited for water-oriented recreation activities. 4. The project is not located in the Coastal Agricultural Overlay Zone, according to Map X of the Land Use Plan, certified September 1990 and, therefore, is not subject to the provisions of the Coastal Agriculture Overlay Zone (Chapter 21.202 ofthe Zoning Ordinance). 6. That the request for a Minor Coastal Development Permit was adequately noticed at least fifteen (15) working days before the date ofthis decision pursuant to Section 21.201.080(B) and (C) ofthe Carlsbad Coastal Development Regulations. 7. That the Planning Director has determined that the project is exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15303(a) - New construction of small structures, of the State CEQA Guidelines and will not have any adverse significant impact on the environment. 8. Developer shall pay the citywide Public Facilities Fee imposed by City Council Policy #17, the License Tax on new construction imposed by Carlsbad Municipal Code Section 5.09.030, and CFD #1 special tax (if applicable), subject to any credits authorized by Carlsbad Municipal Code Section 5.09.040. Developer shall also pay any applicable Local Facilities Management Plan fee for Zone 1, pursuant to Chapter 21.90. All such taxes/fees shall be paid at issuance of building permit. Ifthe taxes/fees are not paid, this approval will not be consistent with the General Plan and shall become void. 9. Prior to the issuance of the building permit. Developer shall submit to the City a Notice of Restriction to be filed in the office of the County Recorder, subject to the satisfaction of the Planning Director, notifying all interested parties and successors in interest that the City of Carlsbad has issued a Minor Coastal Development Permit on the property.
