Description/Explanation: The Miles Pacific Subdivision, hereafter referred to as Ayre, is a proposed New Single Family Luxury community located off of Pio Pico Drive, just east of 1-5. These seventeen homes will renovate an empty, desolate, lot into an exquisite community that will fuse with the existing Pio Pico area. These homes will range from 2800 to nearly 3900 square feet, with both one story and two story components. Utilizing modern energy efficiency guidelines, as well as water wise acumen, Ayre will help California maintain a sustainable future. The six different plans at Ayre are represented by a coastal plantation architectural style. With three to five bedrooms, and an attention to indoor / outdoor spaces, Ayre will provide families with an inviting atmosphere. (a) Any law, ordinance, permit, or govemmental regulation (including those relating to building and zoning) restricting, regulating, prohibiting, or relating to Attachment One (06/03/11) (i) the occupancy, use, or enjoyment of the Land; (ii) the character, dimensions, or location of any improvement erected on the Land; (iii) the subdivision of land; or (iv) environmental protection; or the effect of any violation of these laws, ordinances, or govemmental regulations. This Exclusion 1(a) does not modify or limit the coverage provided under Covered Risk 5. (b) Any governmental police power. This Exclusion 1(b) does not modify or limit the coverage provided under Covered Risk 6. 2. Rights of eminent domain. This Exclusion does not modify or limit the coverage provided under Covered Risk 7 or 8. 3. Defects, liens, encumbrances, adverse claims, or other matters (a) created, suffered, assumed, or agreed to by the Insured Claimant; (b) not Known to the Company, not recorded in the Public Records at Date of Policy, but Known to the Insured Claimant and not disclosed in writing to the Company by the Insured Claimant prior to the date the Insured Claimant became an Insured under this policy; (c) resulting in no loss or damage to the Insured Claimant; (d) attaching or created subsequent to Date of Policy (however, this does not modify or limit the coverage provided under Covered Risk 11,13 or 14); or (e) resulting in loss or damage that would not have been sustained if the Insured Claimant had paid value for the Insured Mortgage. 4. Unenforceability of the lien of the Insured Mortgage because of the inability or failure of an Insured to comply with applicable doing business laws of the state where the Land is situated. 5. Invalidity or unenforceability in whole or in part of the lien of the Insured Mortgage that arises out of the transaction evidenced by the Insured Mortgage and is based upon usury or any consumer credit protection or tmth-in-lending law. 6. Any claim, by reason of the operation of federal bankruptcy, state insolvency, or similar creditors' rights laws, that the transaction creating the lien of the Insured Mortgage, is (a) a fraudulent conveyance or fraudulent transfer, or (b) a preferential transfer for any reason not stated in Covered Risk 13(b) of this policy. 7. Any claim, by reason of the operation of federal bankruptcy, state insolvency, or similar creditors' rights laws, that the transaction vesting the Title as shown in Schedule A, is Attachment One (06/03/11) (a) a fraudulent conveyance or fraudulent transfer; or (b) a preferential transfer for any reason not stated in Covered Risk 9 of this policy. 5. Any lien on the Title for real estate taxes or assessments imposed by governmental authority and created or attaching between Date of Policy and the date of recording of the deed or other instrument of transfer in the Public Records that vests Title as shown in Schedule A. The above policy form may be issued to afford either Standard Coverage or Extended Coverage. In addition to the above Exclusions from Coverage, the Exceptions from Coverage in a Standard Coverage policy will also include the following Exceptions from Coverage; EXCEPTIONS FROM COVERAGE This policy does not insure against loss or damage (and the Company will not pay costs, attomeys' fees or expenses) that arise by reason of 1. Crime Prevention through Environmental Design The proper design and effective use ofthe built environment can lead to a reduction in the fear and incidence of crime and an improvement in the quality of life. The proper design influences this by positively affecting human behavior. The design includes the physical environment, the planned behavior of people, the productive use of space and an effective crime/loss prevention program. Natural Surveillance • Place and design physical features to maximize visibility. This will include building orientation, windows, entrances, walkways, landscape trees and shrubs, fences and any other physical obstruction. • Design entrance ways to have surveillance of the front street. • Design the placement of persons and or activities to maximize surveillance possibilities. • Design lighting that provides for appropriate nighttime illumination of walkways, entrances and driveways. • Consider Inset patios provide cover and reduce surveillance capabilities into the area increasing the risk for residential crime. Natural Access Control • Use walkways, pavement, lighting and landscaping to clearly guide guests to and from selected entrances. • Use real or symbolic barriers like fences or landscaping to prevent and or discourage access to or from dark and or unmonitored areas. Provisions for territorial reinforcement • Use pavement treatments, landscaping and fences to define and outline ownership or property. Lighting Equip building on all sides with light fixtures. All types of exterior doors should be illuminated during the hours of darkness. Use security plants where necessary to prevent entering and tampering. Install walls and fences that are see-through and enhance surveillance. Install lockable gates that allow surveillance. Addressing • Locate numerals where they are clearly visible from the front street • Contrast the numeral's color to the background on which it is affixed. • Numerals shall be no less than four (4) inches in height and illuminated during the hours of darkness. Entrances Area of concern - Courtyards separate a resident from the front street. Separation limits a resident's ability to be the eyes and ears ofthe neighborhood. Separation causes a more secluded atmosphere and limits neighborhood collaboration. Separation limits surveillance into and out of the property. These elements are necessary for the health and safety of the neighborhood and can lead to an increase in the opportunity for crime. • Design front entrances to provide vision from the front door to the front access street. • Keep entranceways clear of clutter. Doors • Do not use of glass within 42 inches of a locking device. • A single or double door shall be equipped with a double cylinder deadbolt with a bolt projection exceeding one inch or a hook-shaped or expanding deadbolt that engages the strike sufficiently to prevent spreading. The deadbolt lock shall have a minimum of five-pin tumblers and a cylinder guard. • Install wooden doors of solid core construction with a minimum thickness of one and three-fourths (1-3/4) inches. • Provide a double door inactive leaf with metal flush bolts having a minimum embedment of five-eighths (5/8) of an inch into the header and footer of the doorframe. Strike Plates • Reinforce all deadbolt strike plates. Choose Strike plates constructed of a minimum 16 U.S. gauge steel, bronze, or brass and secure it to the jamb by a minimum of two screws, which should penetrate at least two (2) inches into the solid backing beyond the surface to which the strike is attached. Re-enforcement ofthe door area around the lock is also suggested. Viewer Arrange entrance doors so that the occupant has a view ofthe area immediately outside the door without opening the door. Except doors requiring a fire protection rating that prohibits them, such a view may be provided by a door viewer having a field of view of not less than 190 degrees. Mounting height should not exceed fifty-four (54) inches from the floor. Windows and sliding glass doors All exterior sliding glass doors and windows should be equipped with locking devices which will keep the sliding panel of the door or window from being opened from the outside horizontally or vertically. Ensure windows have security features preventing the window from being forced to slide or rise. Consider security glazing. A partial list of the design details are listed under architectural guidelines no. 3. As a reminder, lots 1,12 and 16 also have street side elevations in addition to front and rear. This request is in addition to issue no. 4 listed above. 6. Regarding Plan Three, please label the second dwelling unit and provide the square footage. The maximum allowed square footage for a SDU is 640 square feet. 7. Regarding the rear elevations for Plan One, Plan One "X", Plan Three, Plan Four "A", and Plan Four "B", please carry over accent materials (i.e. horizontal and/or decorative wood panel siding, etc.) shown on the front elevations to the rear elevations. Architectural guideline No. 2 states "All elevations of a house, including front, side and rear, should have the same design integrity of forms, details and materials. A lack of details and materials incorporated into the project's rear elevations has been a constant concern with the City's decision makers. Staff strongly suggests that the front, rear and street side elevations (lots 1,12, & 16), have the same design integrity. Furthermore, refer to issue nos. 8 & 9 listed below for other examples on how to enhance the design integrity of the rear elevation. 8. The level of detail and materials used for the deck/balcony columns shown on the front elevation for Plan Four "B" should be carried over to the rear elevation. Currently, the columns shown on the rear elevations are of a somewhat simple design and do not reflect the same level of detail or design integrity as the front elevations. These changes should be reflected on all floor plans. CDP 14-21 - MILES PACIFIC SUBDIVISION October 16, 2014 Page 3 9. Please enhance a portion of the windows located on the rear elevations by adding decorative foam shutter treatment or other similar material as shown on the front elevations. 10. Please confirm that the lot coverage percentages calculated for each lot are consistent with the City's definition for building coverage pursuant to Section 21.04.061 of the C.M.C. Building coverage includes items such as overhanging balconies. Please refer to the definition. 11. Provide a note on the CDP site plan distinguishing the difference in dashed lines shown on each lot. The larger dashed line appears to represent the lots buildable area and the smaller dashed line appears to represent the attached covered verandas. All attached verandas must comply with the front, rear and side yard setback requirements. Engineering: Engineering Department staff has completed the 1st review of the above application submittal documents for completeness. The application documents submitted for this project is complete. Prior to next submittal, it is suggested the following items are adequately addressed: 1. On sheets 2 and 3, show proposed grading on each lot per engineering standard GS-15. Show drainage swales, drainage arrows, flow line elevations, minimum slopes, high point, etc. 2. Show locations of sewer and water laterals. 3. Show rim elevations of all proposed manholes to determine which lots require sewer backflow valve per engineering standard Chapter 6.5.1(5). If the pad elevation is lower than 2-feet above the nearest upstream manhole cover, then a backflow valve is required to prevent sewage backup into the property. Indicate which lots require backflow valves. 4. Provide cross-section of the sewermain located at the eastern boundary of the adjacent property, APN 156-351-19. Indicate the depth and minimum cover ofthe sewermain. 5. On sheet 2 of the site plan, identify the proposed covenant of private drainage easement for the benefit adjacent property, Sohaei Minor Subdivision. 6. Comply with all comments on the red-lined plans. Landscaping: Please advise the applicant to make the following revisions to the plans so that they will meet the requirements ofthe City of Carlsbad's Landscape Manual. Numbers below are referenced on the red line plans where appropriate for ease in locating the area of the comment concern. 1. Plans are too conceptual to provide an appropriate review. The plan plant symbols are not tied to the legend symbol so there is not a way to know where each plant is proposed to be used. The shrubs, trees and ground covers may be very different in size and character. Please provide a separate symbol for each type of shrub (i.e. large evergreen shrub/tree, medium size shrub/tree, small flowering accent shrub/tree, etc.) and ground covers. Please clarify where CDP 14-21 - MILES PACIFIC SUBDIVISION October 16, 2014 Page 4 ground covers are to be installed and what plantings are proposed for the off-site graded areas. Please also clarify proposed plantings of the sewer easement to the west of Lot 9. Final comments are reserved pending receipt of more complete plans. 2. Please show and label all property lines, right-of-ways and easements on the plans. Insure no trees are located within public utility easements. 3. Civil plans reference the landscape plans for a 6' high masonry sound wall and access gate details at the west end of the street. Please address. 4. Please provide conceptual details of all walls and fences with proposed materials and heights for review. 5. The plan shall demonstrate that plants, when installed and at maturity, will be positioned to avoid obstructing motorists' views of pedestrian crossings, driveways, roadways and other vehicular travel ways. On collector streets and larger, landscape elements over 30 inches in height (including planting measured at maturity) as measured from adjacent street grade are not permitted at street corners within a triangular zone drawn from two points, 25 feet outward from the beginning of curves. At medium to high use driveways, the 30 inch height limitation applies at driveways 25 feet from the edge of the apron outward along the curb, then 45 degrees in toward the property. Landscape features (shrubs, trees, fencing, etc.) shall be selected to ensure that no visual impairments or obstructions are located within the sight distance lines. 6. Please provide a bar scale on the plan. 7. Please provide a Maintenance Responsibility Exhibit. The Maintenance Responsibility Exhibit shall be prepared at a scale and size (preferably one sheet) that provides an overall view of the project and shall clearly identify the various areas of landscape maintenance responsibilities (private, common area/homeowners association (HOA), etc). 8. Trees shall be selected from the approved tree replacement list identified in Chapter 6 of the Carlsbad Community Forest Management Plan, unless approved otherwise. Please address. 9. Please provide a Water Conservation Plan in conjunction with the Landscape Concept Plan. This plan shall demonstrate to the City how the proposed development will use all practical means available to conserve water in the landscape. Please provide/address the following: a. Indicate the existing and/or future recycled water systems. b. Provide a colored or hatched plan clearly showing where recycled water, graywater and potable water are proposed to be used for irrigation. c. Irrigation systems for all projects, except for service to a single-family residence or front yard irrigation on individually metered condos, shall be designed to use non-potable, treated recycled water, unless an exemption is approved by the City Utilities Department. d. Written description of water conservation features including addressing xeriscape principles (see Appendix A of the Landscape Manual) within the project. e. Hydrozone diagram: Include one "hydrozone diagram" which identifies grouping of plants within the individual hydrozones (high, moderate, low, very low or special CDP 14-21 - MILES PACIFIC SUBDIVISION October 16, 2014 Pages landscape areas) and which indicates the square footage and irrigation method of each area. f. Separate water service for landscaping (including, but not limited to connections, water meters, and back flow preventers) shall be provided for all commercial/industrial projects, golf courses, parks, and residential common areas in projects over four (4) dwelling units. g. Concept plans shall include calculations which document the maximum allowed annual water use for the landscaped area or maximum applied water allowance (MAWA) and estimated total water use (ETWU). A landscape project shall not exceed the MAWA. The MAWA for a landscape project shall be determined by the following calculation as defined in the City ordinance: MAWA = (ETo)(0.62)[(0.7 x LA) + (0.3 x SLA)]. The ETWU shall be determined by the following calculation as defined in the Landscape Manual: Please provide calculations and worksheets on city forms as found in the Landscape Manual. In addition to the calculations, include a statement on the plans signed under penalty of perjury by the person who prepared the plan that provides: "I am familiar with the requirements for landscape and irrigation plans contained in the city of Carlsbad's landscape manual and water efficient landscape regulations. I have prepared this plan in compliance with those regulations and the landscape manual and agree to comply with all requirements when submitting construction documents. I certify that the plan implements those regulations to provide efficient use of water." 10. The plan shall provide that only low volume or subsurface irrigation shall be used to irrigate any vegetation within twenty-four inches of an impermeable surface unless the adjacent impermeable surfaces are designed and constructed to cause water to drain entirely into a landscaped area. 11. Please add the following notes to the plans and insure plans show that these requirements are met: Slopes 6:1 or steeper requiring erosion control measures as specified herein shall be treated with one or more ofthe following planting standards: a. Standard 1 - Cover Crop/Reinforced Straw Matting: Cover crop shall be a seed mix typically made up of quick germinating and fast covering grasses, clovers, and/or wild flowers. Submit the specific seed mix for City approval prior to application. The cover crop shall be applied at a rate and manner sufficient to provide 90% coverage within thirty (30) days. Type of reinforced straw matting shall be as approved by the city and staked to the slope as recommended by the manufacturer. Reinforced straw matting shall be required when planting occurs between August 15 and April 15. The cover crop and/or reinforced straw mat shall be used the remainder ofthe year. CDP 14-21 - MILES PACIFIC SUBDIVISION October 16, 2014 Page 6 b. Standard #2 - Ground Cover One hundred (100%) percent ofthe area shall be planted with a ground cover known to have excellent soil binding characteristics (planted from a minimum size of flatted material and spaced to provide full coverage within one year). c. Standard #3-LowShrubs Low spreading woody shrubs (planted from a minimum of 2-3/4 inch liners) shall cover a minimum of seventy (70%) percent ofthe slope face (at mature size). d. Standard #4 - Trees and/or Large Shrubs Trees and/or large shrubs shall be (planted from a minimum of 1 gallon containers) at a minimum rate of one (1) per two hundred (200) square feet. Slopes - 6:1 or steeper and: a. 3' or less in vertical height and are adjacent to public walks or streets require at minimum Standard #1. b. 3' to 8' in vertical height require Standards #1 (erosion control matting shall be installed in lieu of a cover crop), #2 and #3. c. In excess of 8' in vertical height require Standards #1 (erosion control matting shall be installed in lieu of a cover crop), #2, #3, and #4. Areas graded flatter than 6:1 require Standard #1 (cover crop) with temporary irrigation when they have one or more ofthe following conditions: a. Sheet graded pads not scheduled for improvements within 6 months of completion of rough grading. b. A potential erosion problem as determined by the City. c. Identified by the City as highly visible areas to the public or have special conditions that warrant immediate treatment. 12. Please review the plans with the City of Carlsbad Fire Marshall to determine if any fire suppression zones are required. Provide documentation of findings for cross checking and address any requirements as appropriate. 13. RETURN REDLINES and provide 2 copies of ail plans (concept, water conservation, fire protection, and colored water use plan) for the next submittal.
