INSTRUCTIONS:
To address post-development pollutants that may be generated from development projecis, the Cily requires that new development and
signlficanl redeveiopmenl priority projects incorporate Permanent Storm Waler Best Management Practices (BMP's) into the project
design per the City's Standard Urban Stormwater Management Plan (SUSMP). To view the SUSMP, refer lo the Engineering Standards
(Volume 4, Chapter 2).
Initially this questionnaire must be completed by the applicant in advance of submitting for a developmenl application (subdivision,
discretionary permits and/or construction pennits). The results of the questionnaire detennine the level of storm water slandards that
must be applied lo a proposed development or redevelopment project. Depending on the outcome your project will eilher be subject to
Standard Stormwater Requirements or be subject to additional crileria called Priority Development Project Requirements. Many
aspects of project site design are dependent upon the storm water standards applied to a project
Your responses to the questionnaire represent an initial assessment of the proposed project conditions and impacts. City staff has
responsibility tor making the final assessment after submission of the development application. If staff determines lhat the queslionnaire
was incorrectly filled out and is subject lo more stringent storm water standards than initially assessed by you, this will result in the return
of the development application as incomplete. In this case, please make the changes to the questionnaire and resubmit to the City,
If you are unsure about the meaning of a question or need help in determining how to respond to one or more of the questions, please
seek assistance from Land Developmenl Engineenng staff
A separate completed and signed questionnaire must be submitted for each new development applicalion submission. Only one
completed and signed questionnaire is required when multiple development applications forthe same project are submitted concurrently.

for the project

The City has completed a review of the application for a Minor Coastal Development Permit for the
development of a 639 square foot second dwelling unit above a detached garage located at 4158
Highland Drive.
It is the City Planner's determination that the project CDP 15-16 - 5350 TARMAN SECOND DWELLING
UNIT, is consistent with the City's applicable Coastal Development Regulations (Chapters 21.201 -
21.205) and with all other applicable City ordinances and policies. The City Planner, therefore,
APPROVES this request based upon the following:
1. That the development is in conformity with the public access and public recreation policies of
Chapter 3 of the Coastal Act, in that no opportunities for coastal access are available from the
subject site, nor are public recreation areas required of the project in that the property is not
located adjacent to the shore and no opportunities for coastal access are available from the
subject site, nor are public recreation areas required of the project.
2. The proposed development will have no adverse effect on coastal resources, in that the property is
not located adjacent to a body of water, the lot is already disturbed and developed with a single-
family home and garage, and the Second Dwelling Unit above the garage will not affect steep
slopes or mature vegetation.
3. That the proposed development is in conformance with the Mello il Segment of the Certified Local
Coastal Program and all applicable policies in that the site is designated Residential Low-Medium
(RLM) density for one-family residential and is already disturbed and developed with one single-
family home and a garage. The development consists of the addition of a 639 square foot second
dwelling unit constructed above a garage. The proposed Second Dwelling Unit will not obstruct
views of the coastline as seen from public lands or the public right-of-way, nor otherwise damage
the visual beauty of the coastal zone. No agricultural uses currently exist on the site, nor are there
any sensitive resources located on the property. Furthermore, the proposed second dwelling unit
is not located in an area of known geologic instability or flood hazards.

4. The project is consistent with the provisions of the Coastal Resource Protection Overlay Zone
(Chapter 21.203 of the Zoning Ordinance) in that the project will adhere to the city's Master
Drainage Plan, Grading Ordinance, Storm Water Ordinance, Standard Urban Storm Water
Mitigation Plan (SUSMP), and Jurisdictional Urban Runoff Management Plan (JURMP) to avoid
increased urban runoff, pollutants, and soil erosion. No steep slopes or native vegetation are
located on the subject property and the site is not located in an area prone to landslides, or
susceptible to accelerated erosion, floods, or liquefaction.
5. That the request for a minor coastal development permit was adequately noticed at least ten (10)
calendar days before the date of this decision pursuant to Section 21.201.080(B) and (C) of the
Carlsbad Coastal Development Regulations.
6. That the City Planner has determined that the project is exempt from the requirements of the
California Environmental Quality Act (CEQA) per Section 15303 - New Construction or Conversion
of Small Structures of the State CEQA Guidelines and will not have any adverse significant impact on
the environment.
7. The City Planner has reviewed each of the exactions imposed on the Developer contained in this
resolution, and hereby finds, in this case, that the exactions are imposed to mitigate impacts caused
by or reasonably related to the project, and the extent and the degree of the exaction is in rough
proportionality to the impact caused by the project.
Conditions:
1. The City Planner does hereby APPROVE the Minor Coastal Development Permit, CDP 15-16, for the
project entitled TARMAN SECOND DWELLING UNIT, Exhibits "A" - "F", dated September 14, 2015,
on file in the Planning Division and incorporated by this reference, subject to the conditions herein
set forth.
2. If any of the following conditions fail to occur; or if they are, by their terms, to be implemented and
maintained over time, if any of such conditions fail to be so implemented and maintained according
to their terms, the City shall have the right to revoke or modify all approvals herein granted; deny or
further condition issuance of all future building permits; deny, revoke or further condition all
certificates of occupancy issued under the authority of approvals herein granted; record a notice of
violation on the property title; institute and prosecute litigation to compel their compliance with
said conditions or seek damages for their violation. No vested rights are gained by Developer or a
successor in interest bythe City's approval ofthis Minor Coastal Development Permit.
3. Staff is authorized and directed to make, or require the Developer to make, all corrections and
modifications to the Minor Coastal Development Permit documents, as necessary to make them
internally consistent and in conformity with the final action on the project. Development shall occur
substantially as shown on the approved Exhibits. Any proposed development different from this
approval, shall require an amendment to this approval.
4. The Developer shall comply with all applicable provisions of federal, state, and local laws and
regulations in effect at the time of building permit issuance.

5. If any condition for construction of any public improvements or facilities, or the payment of any fees
in-lieu thereof, imposed by this approval or imposed by law on this Project are challenged, this
approval shall be suspended as provided in Government Code Section 66020. If any such condition
is determined to be invalid this approval shall be invalid unless the City Council determines that the
project without the condition complies with all requirements of law.
6r Developer/Operator shall and does hereby agree to indemnify, protect, defend, and hold harmless
the City of Carlsbad, its Council members, officers, employees, agents, and representatives, from
and against any and all liabilities, losses, damages, demands, claims and costs, including court costs
and attorney's fees incurred by the City arising, directly or indirectly, from (a) City's approval and
issuance of this Minor Coastal Development Permit, (b) City's approval or issuance of any permit or
action, whether discretionary or nondiscretionary, in connection with the use contemplated herein,
and (c) Developer/Operator's instailation and operation of the facility permitted hereby, including
without limitation, any and all liabilities arising from the emission by the facility of electromagnetic
fields or other energy waves or emissions. This obligation survives until all legal proceedings have
been concluded and continues even if the City's approval is not validated.
7. This approval shall become null and void if building permits are not issued for this project within 24
months from the date of project approval.
8. Developer shall pay the citywide Public Facilities Fee imposed by City Council Policy #17, the License
Tax on new construction imposed by Carlsbad Municipal Code Section 5.09.030, and CFD #1 special
tax (if applicable), subject to any credits authorized by Carlsbad Municipal Code Section 5.09.040.
Developer shall also pay any applicable Local Facilities Management Plan fee for Zone 3, pursuant to
Chapter 21.90. All such taxes/fees shall be paid at issuance of building permit. If the taxes/fees are
not paid, this approval will not be consistent with the General Plan and shall become void.
9. Prior to the issuance of a building permit, the Developer shall provide proof to the Building Division
from the Carlsbad Unified School District that this project has satisfied its obligation to provide
school facilities.
10. Prior to the issuance of the building permit. Developer shall submit to the City a Notice of
Restriction to be filed in the office of the County Recorder, subject to the satisfaction of the City
Planner, notifying all interested parties and successors in interest that the City of Carlsbad has
issued a Minor Coastal Development Permit on the property. Said Notice of Restriction shall note
the property description, location ofthe file containing complete project details and all conditions of
approval as well as any conditions or restrictions specified for inclusion in the Notice of Restriction.
The City Planner has the authority to execute and record an amendment to the notice which
modifies or terminates said notice upon a showing of good cause by the Developer or successor in
interest.
The Notice of Restriction shall include language to declare that:
a. The property owner(s) shall reside in either the main dwelling unit or the second
dwelling unit, unless a lessee leases both the main dwelling and the second dwelling
unit.
b. The obligations and restrictions imposed on the second dwelling unit per this chapter
are binding on all present and future property owners.

11. Approval of this request shall not excuse compliance with all applicable sections of the Zoning
Ordinance and all other applicable City ordinances in effect at time of building permit issuance,
except as otherwise specifically provided herein.
12. Developer shall comply with the city's Stormwater Regulations, latest version, and shall
implement best management practices at all times. Best management practices include but are
not limited to pollution control practices or devices, erosion control to prevent silt runoff during
construction, general housekeeping practices, pollution prevention.
13. Prior to hauling dirt or construction materials to or from any proposed construction site within
this project. Developer shall apply for and obtain approval from, the City Engineer for the
proposed haul route.
14. An automatic fire sprinkler system is required for the project unless waived by the Fire
Department.
15. if an automatic flre sprinkler system is required, installation of a one inch (1") or greater water
service and water meter will be required.

CEQA Determination:
This is to advise you that after reviewing the application for the project referenced above, the City has
determined that the following environmental review process (pursuant to CEQA) will be required for the
project:
The project is exempt from the provisions of CEQA, pursuant to CEQA Categorical Exemption for New
Construction or Conversion of Small Structures - State CEQA Guidelines Section 15303. No
environmental review is required forthe project.
A Notice of Exemption will be filed after approvai of the project with the San Diego County Clerk's Office

Planning:

3. On Sheet A1.02, please clarify that the SDU is the only work under Coastal Development Permit CDP
15-16 and the garage and addition to the home are under a separate building permit.
Fire:
1. An automatic fire sprinkler system is required for this project since:
a. The project is access from a private driveway less than 24 feet in width; and
b. The center or the furthest most wall or projection of the dwelling exceeds 150 feet from the
"center-line" of the nearest fire department access. This distance is measured along a path
that simulates the route a firefighter may take to access all portions of the exterior of a
structure from the nearest public road or fire access road.
2. Provide notes on all plans submitted for review that indicate that fire sprinklers are required.
3. Submit fire sprinkler plan to the Fire Department for review.
4. Installation of a one inch (1") or greater water service and water meter is required. This is to ensure
that there is adequate water provided in the event of a fire sprinkler activation during periods of

TO COMPLETE THE APPUCATION
Planning:
The proposed project does not meet the definition of a Second Dwelling Unit. A Second Dwelling
Unit must provide complete independent living facilities which includes a full kitchen containing a
full size refrigerator, oven and cooktop. A wet bar, as proposed, does not qualify as a full kitchen.
Please add a kitchen to the Second Dwelling Unit.
ISSUES OF CONCERN
Planning:
1. The Second Dwelling Unit cannot be open to the area below unless the square footage of the area
below plus the Second Dwelling Unit complies with the 640 square foot maximum size.
2. The proposed lanai is considered a habitable area. A detached, habitable structure/area is not
permitted on a lot that contains a Second Dwelling Unit. It is suggested that the proposed lanai be
redesigned without doors to create a covered patio area that is completely open to the exterior on
two sides and therefore not considered habitable.
3. Please ensure that the garage and Second Dwelling Unit meet the required 10' side yard setback.
See Engineering comment # 1 below.
4. Detached accessory structures are limited to one story and 14' in height with a minimum 3:12 roof
pitch and 10' in height with a flat roof. Second Dwelling Units are the exception to the height and
story requirement when constructed above a detached garage. Therefore, only the Second Dwelling
Unit is permitted to exceed the 10'/14' requirement. The roof over the proposed lanai shall not
exceed 14' with a minimum 3:12 roof pitch or 10' with iess than a 3:12 roof pitch. In addition,
please remove the covered roof above the deck on the north side of the Second Dwelling Unit. The
covered deck area on the west side ofthe Second Dwelling Unit will be permitted.
5. Please change "Game Room" to Second Dwelling Unit.
6. Please submit one set of mailing labels for occupants within a 100' radius of the property. Only the
100' owner's labels were submitted.

Engineering:
1. The south line ofthe project site is dimensioned 276.99', the same length as the south line of Lot 1
of Map 2152. The legal description on page 2 of the grant deed submitted with the project
application. Doc # 2012-0270643, except the southerly five (5) feet of Lot 1 from the project site.
Therefore these two dimensions cannot be the same. The length ofthe south property line may be
less than the 276.99 shown and the setback from the garage to the south property line may be 7'-6"
