However, through the city preliminary review process a reduced front yard setback of fifteen feet has been supported by the city staff,as noted in the PRE 2017-003 issued letter on February 16, 2017. The required twenty feet front yard setback for street facing garages will be maintained. The property owner is also requesting a rear yard setback reduction from 10 feet to 8.3 feet based on the five necessary findings and the supporting analysis described below. Also, in support ofthe rear yard setback reduction are five neighboring properties located C 2340, 2380, 2775, 3100 Ocean Street and 252 Normandy Lane, which have been granted similar variances by the city staff. Additional support by the city can be recognized according to Carlsbad municipal code section 21 -46,060 which states a formula can be adopted by the city to establish appropriate and practical setbacks in a residential zone. The property at 2680 is nonconforming or substandard in size, 3250 square feet which is 43 percent of the 7500 square feet minimum lot size for a R-3 zone.In addition to being substandard in lot size, the property is 50 feet in width, the minimum for a R3 zone parcel is 60 feet and therefore this lot falls short by 10 feet, or by 17 percent,of the required minimum lot width. We strongly urge the city staff to recognize the 17 percent reduction in the required rear year setback parallels the substandard lot width which is 17 percent short of the required minimum lot width. It is understood that the rear yard setback is twice the lot width in a R-3 zone, but due to the substandard lot size it is impractical, creates economic hardship and denies the property owner equal rights to develop the property if zoning regulations established for conforming properties are enforced on nonconforming lots of substandard size and dimension. Again, we urge you to recognize this simple formula, supported by the city municipal code to allow the property owner similar development rights as other properties located within this neighborhood. Lastly, the set back variance is considered minor in nature because the reduced front yard set back and read yard set back do not exceed 75 percent of the required setbacks. 2680 Ocean Street Justification for Administrative Variance 1.That because of special circumstances applicable to the subject property, including size, shape, topography, location of surroundings, the strict application of the zoning ordinance deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classification. The lot is substandard at 3250 square feet, which is 43 percent of the 7500 square feet minimum lot size for the R-3 zone. In addition to being substandard in size, the property is also nonconforming with a 50 feet lot width, minimum lot width for a lot in the R-3 zone is 60 feet. 2.That the minor variance shall not constitute a grant of special privileges inconsistent with the limitation upon other properties in the vicinity and zone in which the subject property is located and is subject to any conditions necessary to assure compliance with this finding. The surrounding neighborhood consists entirely of substandard lot sizes and developed properties that generally do not meet the current R-3 development standards. Most ofthe surrounding lots have been developed in a way that they do not meet most of the current required development standards of the R-3 zone. Deviations on other lots include, front yard, rear yard, and side yard setback reductions and lack of a required two car garage. 3.That the minor variance does not authorize a use or activity which is not otherwise expressly authorized by the zone regulation governing the subject property. The granting ofa minor variance to reduce the required front yard setback from 20 feet to 15 feet and the rear yard setback from 10 feet to 8.3 feet does not authorize a use which is not others expressly permitted by the zoning regulations. Therefore a deviation from the setback standards doesn't not authorize a use of activity which is not authorized by the zone. 4.That the minor variance is consistent with the general purpose and intent of the General Plan and any applicable specific or master plans. The project consists ofa new single-family home with a two-car garage. The proposed use is expressly authorized by the Zoning Ordinance and General Plan regulations governing the subject property. The granting of a Minor Variance for front yard and rear yard setbacks does not allow for or authorize a use not expressly permitted. 5.The minor variance is consistent with the general purposed and intent of the certified local coastal program and does not reduce or in any manner adversely affect the requirements for protection of coastal resources. The granting ofa Minor Variance is consistent with and implements the requirements of the Local Coastal Program and will not have an adverse effect on coastal resources as discussed below in Section "D"and will have no impacts on sensitive environmental resources. Therefore, granting such a variance will not adversely affect the Local Coastal Program. D.
