The City Planner shall make the final determination regarding a project's cost of development. The primary basis for determining cost of development will be the application of dollar costs per square foot for different types of residential construction. These costs are set by the International Conference of Building Officials (ICBO) and are applied throughout San Diego County. Please complete the following information to assist in the determination of this project's cost of development (Contractor proposals may also be submitted for consideration by the City Planner). To view the BMP Manual, refer to the Engineering Standards (Volume 5). This questionnaire must be completed by the applicant in advance of submitting for a development application (subdivision, discretionary permits and/or construction permits). The results of the questionnaire determine the level of storm water standards that must be applied to a proposed development or redevelopment project Depending on the outcome, your project will either be subject to 'STANDARD PROJECT' requirements or be subject to 'PRIORITY DEVELOPMENT PROJECT' (PDP) requirements . Your responses to the questionnaire represent an initial assessment of the proposed project conditions and impacts. City staff has responsibility for making the final assessment after submission of the development application. If staff determines that the questionnaire was incorrectly filled out and is subject to more stringent storm water standards than initially assessed by you, this will result in the return of the development application as incomplete. In this case, please make the changes to the questionnaire and resubmit to the city. If you are unsure about the meaning of a question or need help in determining how to respond to one or more of the questions, please seek assistance from Land Development Engineering staff. That helped comply with the soils engineer's recommendations for the site, allowed the roof designs to be more aesthetically pleasing, and kept the overall height a few inches under the limit you indicated would be appropriate for the site. Please let me know if you have any questions. Thank you. RECIPROCAL GRADING AUTHORIZATION LETTER In consideration of the sale of certain real property by San Diego Design and Development Services, LLC, a California limited liability company, ("Grantor") to Mark D. Francis, ("Grantee"), which real property is the subject of this Authorization and which is known as Parcel I, Parcel Map No. 20880, the Grantor hereby provides continuing authorization to Grantee, his contractors, engineers, inspectors, surveyors, agents, successors and assigns, to deposit fill material and to move, compact, do all grading, and otherwise work with the fill material and modify the existing grading as needed on, over, under, and upon, part of Grantor's property known as Parcel 2, Parcel Map #20880, as such is generally shown on the attached Exhibit A. The parties acknowledge that Sheet 4 of the existing grading plan prepared by Omega Engineering (sheet dated 6/26/2012 -referencing CDP 11-17 approved by the City of Carlsbad on 6/30/2012) attached as Exhibit B shall also be followed as to the grading on Parcel 2, with both Exhibits construed in hannony and with minor inconsistencies resolved in favor of allowing grading consistent with those Exhibits. As such, some minor deviations from the attached drawings may be necessary to complete the grading work to required standards and to maintain slope stability, and some disturbance on the driveway and outside the area of the grading as shown on the attached drawings may occur. Minor deviations shall not require Grantor's prior consent. However, any deviation into Parcel 2 by over 10 feet beyond the approximate limit of slope key as noted on Exhibit A, or that extends the fill into Parcel 2 by more than 8 feet beyond the approximate limit of slope, shall require Grantor's prior written consent. All grading shall be completed by Grantee according to a grading design from a licensed engineer and according to all required municipal authoriz.ations and permits. The parties also acknowledge that the grading approved by the City as shown on Sheet 4 will not be undertaken as shown and approved due to the fact that no basement excavation will take place on Parcel 1. Therefore, that approved grading plan will have to be re-done and reapproved to reflect the revised topography planned for Parcel l with no basement or a new grading plan will be required to reflect the revised topography. Grantor agrees to continue to reasonably cooperate with Grantee in the future to assistGrantee in completing any engineering, plans. securing municipal approvals, completing site work, or in otherwise assisting in Grantee's efforts to complete the grading without additional cost or compensation to Grantor. This Authorization will continue until the grading is completed, final inspections are made, and all permits for the work are deemed complete and the Authorization will be binding upon Grantor's and Grantee's successors in interest and title. Grant.ee shall not allow any mechanic's or materialman's liens or other liens or charges for materials supplied or work performed at the request of Grantee to attach against Grantor's property and Grantee indemnifies Grantor against any cost or expense incurred by Grantor to release or bond around any mech:rnic's or materialman's liens or other liens or charges which arise from materials supplied or work performed by Grantee on Parcel 2. Reciprocal Provisions: In consideration of the foregoing, if Grantee grades onto Parcel 2 before Gran.tor undertakes any of its own grading or filling of dirt on Parcel 2, Grantee also grants to Gran.tor the right to later excavate, grade, and disturb the area on the north side of Parcel 2 where Grantee had deposited fill and graded so long as such later actions by Gran.tor do not impair or diminish the lateral or subjacent support for Parcel 1. Should Grantor undertake later grading and filling activities that disturb the area filled and graded by Grantee on Parcel 2, all of Gran.tor's grading and filling activities shall be undertaken in accordance with the terms of this Authorization as stated above, but with Gran.tor assuming the obligations of Grantee with respect to such activities, with Gran.tor indemnifying Grantee, and with Grantee also assuming duties to cooperate with Gran.tor in such efforts as is required of Grantor herein. Further, also in consideration of the foregoing, if Grantor undertakes filling and grading activities on Parcel 2 before Grantee undertakes grading or filling of dirt on Parcel 1, Grantee grants to Grantor the right to deposit fill material and to move, compact, do all grading, and otherwise work with the fill material and modify the existing grading as needed on, over, under, and upon, the southern part of Parcel 1 so long as such actions by Gran.tor do not impair or diminish the lateral or subjacent s1.t-pport for Parcel 1. Should Grantor undertake such grading and filling activities on Parcel 2 that extend into Parcel I, all of Grantor's grading and filling activities shall be undertaken on Parcel 1 in accordance with the terms of this Authorization as stated above, but with Grantor assuming the obligations of Grantee with respect to such activities, with Grantor indemnif),ing Grantee, and with Grantee also assuming duties to cooperate with Grantor in such efforts as is required. of Grantor herein. Finally, in consideration of the foregoing, Grantee also grants to Grantor the right to excavate, grade, and disturb the west 5 feet of Parcel 1, along the east side of the driveway serving Parcel 2 as is shown on Exhibit C, in order for Grantor to install utility lines, conduits, or other underground installations along the east side of the driveway in the panhandle portion of Parcel 2, so long as such actions by Grantor do not impair or diminish the lateral or subjacent support for Parcel 1 or harm any installed improvements or landscaping. In so doing, all such activities shall be undertaken in that area of Parcel 1 in accordance with the terms of this Authorization as stated above, but with Gran.tor assuming the obligations of Grantee with respect to such activities, with Gran.tor indemnifying Grantee, and with Grantee also assuming duties to cooperate with Granter in such efforts as is required of Grantor herein. --<•-, Regardless of anything stated to the contrary herein. these authorizations shall expire 3 years from last date this Authorization is signed by Grantor or Grantee.
