Dear Greg:
Today Chris faxed me a copy of an executed amendment dated March 27,1998 modifying the original
easement in regard to the hours of use. Our entire disagreement of the past weeks in regard to the
modification of this easement is derived from the simple fact that the amendment was never recorded,
so I was unaware until today that the hours of use had ever been amended. As a result, I was under
the impression that the City was now trying to extend the hours of use beyond those specified in the
easement agreement which is currently in effect. I am now aware that the hours of use had already
been extended prior to my acquiring the property.
This being the case, the only issue left to resolve is how to make the other two revisions. I have
already submitted two forms for your review. I believe the first was the one that got us closest to
putting this matter to rest. At your request, I have removed section 2, and adjusted the numbering.
Please review and let me know if I can send this off to be signed and notarized.
