Box3103 Carlsbad CA 92009 SUBJECT: CDP 96-09 - BLF INFORMATION CENTER The City has completed a review of the application for a Minor Coastal Development Permit for development located on the north side of Batiquitos Lagoon, between Gabbiano Lane and Melodia Terrace, adjacent to the Batiquitos Sewer Pump Station. It is the Planning Director's determination that the project Batiquitos Lagoon Foundation Information Center, CDP No. 96-09, is consistent with the applicable City's Coastal Development Regulations (Chapters 21.201 - 21.205) and with all other applicable City ordinances and policies. The Planning Director, therefore, APPROVES this request based upon the following: Findings: 1. That the total cost of the proposed relocation and installation of the single-wide mobile building, related site preparation and improvement installation is less than $60,000. 2. That the proposed development requires no discretionary approvals other than a Minor Coastal Development Permit. 3. That the development has no adverse effect individually or cumulatively on coastal resources or public access to the shoreline or the coast, in that no development will occur in the wetlands, upland vegetation or other sensitive areas and all existing and future public access points will remain. The information center will offer decent programs that will increase the public's ability to access and enjoy the coastal resources of Batiquitos Lagoon. 4. The proposed information center is consistent with the Aviara Master Plan, as required by Chapter II-4, Section B.1 of the Carlsbad LCP since it continues to implement the goals of the Batiquitos Lagoon Enhancement Project with regard to open space preservation and pedestrian trail support. b. No grading is proposed, therefore no erosion control techniques are necessary since there will be no increase in runoff. c. The only landscaping proposed is a native species garden, containing indigenous plants of the local area in accordance with Chapter II-4, Section B.5 of the Carlsbad LCP. d. No adverse visual effects will result from placement and operation of the proposed information center since the building is relatively small and of a light brown color that blends into the nearby vegetation. 5. That the development is in conformity with the public access and public recreation policies of Chapter 3 of the Coastal Act, in that it increases the opportunity for public education about the Coastal Zone and its resources, as well as guided tours of the Batiquitos Lagoon, without altering existing coastal access. Conditions: 1. The Planning Director does hereby APPROVE the Minor Coastal Development Permit for the temporary information center project entitled "Batiquitos Lagoon Foundation Information Center". (Exhibit "A", dated November 26,1996, on file in the Planning Department and incorporated by this reference, subject to the conditions herein set forth. Staff is authorized and directed to make, or require the Developer to make, all corrections and modifications to the Minor Coastal Development Permit documents, as necessary to make them internally consistent and in conformity with the final action on the project. Development shall occur substantially as shown on the approved Exhibits. Any proposed development substantially different from this approval, shall require an amendment to this approval. 2. This Minor Coastal Development Permit is approved for a period of six months. Occupation of the temporary information center shall cease and all associated improvements shall be removed on or prior to May 25, 1996, unless a Conditional Use Permit and Coastal Development Permit to allow CDP 96-09 - BLF INFOR \TION CENTER NOVEMBER 26, 1996 PAGE 3 the information center on a more permanent basis have been approved by the City of Carlsbad Planning Commission. 3. The Developer shall comply with all applicable provisions of federal, state, and local ordinances in effect at the time of building permit issuance. 4. An exterior lighting plan including parking areas shall be submitted for Planning Director approval. All lighting shall be designed to reflect downward and avoid any impacts on adjacent homes or property. 5. No outdoor storage of materials shall occur onsite unless required by the Fire Chief. In such instance a storage plan will be submitted for approval by the Fire Chief and the Planning Director. 6. If any of the foregoing conditions fail to occur; or if they are, by their terms, to be implemented and maintained over time; if any of such conditions fail to be so implemented and maintained according to their terms, the City shall have the right to revoke or modify all approvals herein granted; deny or further condition issuance of all future building permits; deny, revoke or further condition all certificates of occupancy issued under the authority of approvals herein granted; institute and prosecute litigation to compel their compliance with said conditions or seek damages for their violation. No vested rights are gained by Developer or a successor in interest by the City's approval of this Minor Coastal Development Permit. CITY OF CARLSBAD MICHAEL J.
