Page 3, Condition Number 5 should read: All applicable conditions of CT 92-02 and CT 92-02(A) are incorporated by reference to this approval. 2. Page 3, Condition Number 7 should read: Additional on-site public water mains and fire hydrants are required, as shown on the approved improvement plans for CT 92-02(A). 3. Page 3, Condition Number 8 should read: Applicant shall submit a site plan to the Fire Department for approval, which depicts location of required, proposed and existing public water mains and fire hydrants. The plan should include off-site fire hydrants within 200 feet of the project, as shown on the approved improvement plans for CT 92-02(A). 4. Page 3, Condition Number 9 should read: Applicant shall submit a site plan depicting emergency access routes, driveways and traffic circulation for Fire Department approval, as shown on the approved improvement plans for CT 92-02(A). 5. Page 4, Condition Number 12 should read: Native vegetation which presents a fire hazard to structures shall be modified or removed in accordance with the specifications contained in the City of Carlsbad Landscape Guidelines Manual, as shown on the approved landscape plans for CT 92-02(A), and as approved by the Fire Department. CDP 97-02 TO 4 ALLOW THE CONSTRUCTION OF 93 SINGLE FAMILY HOMES ON PREVIOUSLY SUBDIVIDED LOTS WITHIN CT 5 92-02(A), AND TO ALLOW MINOR LOT GRADING ASSOCIATED WITH THE EXPANSION OF THE PAD AREAS 6 OF SOME OF THE APPROVED SINGLE FAMILY LOTS ON PROPERTY GENERALLY LOCATED WEST OF AVIARA PARKWAY BETWEEN CAMINO DE LAS ONDAS AND g PALOMAR AIRPORT ROAD IN LOCAL FACILITIES MANAGEMENT ZONE 20. 9 CASE NAME: SAMBI SEASIDE HEIGHTS CASE NO.: CDP 97-0210 j j WHEREAS, Kaufman and Broad of San Diego, Inc, "Developer", has filed a 12 verified application with the City of Carlsbad regarding property owned by Sambi Seaside 13 Heights, LLC, "Owner", described as 14 Lots 37-111 and lots 120-137 of map 13378 of Carlsbad Tract 15 92-°2 16 ("the Property"); and 17 WHEREAS, said verified application constitutes a request for a Coastal 18 Development Permit as shown on Exhibits "A"-"HH" dated April 16, 1997, on file in the 19 Planning Department, CDP 97-02 as provided by Chapter 21.201.040 of the Carlsbad Municipal 20 Code; and 21 -^ WHEREAS, on March 8, 1995, the California Coastal Commission approved 23 Coastal Development Permit 6-94-131, dated March 8, 1995. All conditions of CDP 6-94-131 24 are applicable to this project; and 25 WHEREAS, the Planning Commission did, on the 16th day of April 1997, hold a 26 duly noticed public hearing as prescribed by law to consider said request; and 27 28 1 WHEREAS, at said public hearing, upon hearing and considering all testimony 2 and arguments, if any, of all persons desiring to be heard, said Commission considered all factors 3 relating to CDP 97-02. 4 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 5 Commission of the City of Carlsbad as follows: 6 7 A) That the foregoing recitations are true and correct. g B) That based on the evidence presented at the public hearing, the Commission APPROVES Coastal Development Permit CDP 97-02, based on the following 9 findings and subject to the following conditions: Findings;10 * < 1. That the proposed development is in conformance with the Certified Local Coastal Program and all applicable policies in that (1) the structural placement and 12 architecture of the single family residential structures is consistent with the applicable R-l-7500 zone development standards (implementing zone for this 13 project); (2) the proposed minor lot grading (i.e. encroachment into existing manufactured slopes of equal to or greater than 25%) for purposes of increasing the rear and side yard pad areas for some of the lots is consistent with the Slope 15 Preservation policies of the Mello II LCP because these existing manufactured slopes are not subject to such policies; (3) no sensitive coastal resources will be 16 impacted by the proposed minor grading; and, (4) adequate drainage and erosion control measures have been incorporated into the project. 17 2. This project is a part of a larger project (CT 92-02(A)) which has already been issued a Coastal Development Permit by the California Coastal Commission based 19 upon findings of consistency with the Mello II Coastal Resource Protection Overlay Zone and the Coastal Agricultural Overlay Zone. All conditions of the existing 20 approved Coastal Development Permit for CT 92-02(A) have been satisfied (i.e. receipt of Federal and State Resource Agency permits, purchase of mitigation 21 credits from the Carlsbad Highlands Mitigation Bank and payment of an Agricultural Conversion Mitigation Fee to the California Coastal Conservancy). 2^ Conditions: 24 Planning: 25 1. The Planning Commission does hereby APPROVE the Coastal Development Permit for the project entitled Sambi Seaside Heights (Exhibit(s) "A"-"HH" dated April 16,1997, 26 on file in the Planning Department and incorporated by this reference, subject to the conditions herein set forth.) Staff is authorized and directed to make, or require Developer to make, all corrections and modifications to the Coastal Development 28 PC RESO NO. 4082 -2- 1 Permit document(s), as necessary, to make them internally consistent and in conformity with final action on the project. Development shall occur substantially as shown in the 2 approved Exhibits. Any proposed development substantially different from this approval, shall require an amendment to this approval. 4 2. This project is approved subject to the condition that the sideyard fencing which is located between lots 46 and 47 and the public trail be constructed of masonry 5 block with a stucco finish. These walls shall be constructed prior to the issuance of certificates of occupancy for lots 46 and 47. 6 Engineering: g 3. The typical drainage system shown on Sheet 1 of the plot plans has been reviewed by the City Engineer and is approved subject to the following conditions: 9 a. Existing typical lot grading standard GS-15 shall be incorporated for all lots 10 except as shown on alternate section D/D on Sheet 1 of the plot plans for this ! j project. 12 b. The 15 lots identified in the above mentioned alternative drainage design shall have: Deepened Footings, PVC yard drains, retaining wall drainage systems, 13 and shall comply with specific recommendations from the project's Soils Engineer.14 1 ^ c. Any changes to the alternative drainage design shall be approved by the City Engineer prior to individual unit construction prior to pad certification by the 16 proj ect Engineer. 17 4. The fence plan and grading plan shall comply with the City of Carlsbad Engineering sight distance corridor standards.18 ,„ 5. All applicable conditions of CT 92-02 and CT 92-02(A) are incorporated by reference to this approval. 20 Fire: 21 6. Prior to the issuance of building permits, complete building plans shall be approved 22 by the Fire Department. 23 7. Additional on-site public water mains and fire hydrants are required, as shown on the 24 approved improvement plans for CT 92-02(A). 25 8. Applicant shall submit a site plan to the Fire Department for approval, which depicts location of required, proposed and existing public water mains and fire hydrants. The 2" plan should include off-site fire hydrants within 200 feet of the project, as shown on 27 the approved improvement plans for CT 92-02(A). 28 PC RESO NO. 4082 -3- 1 9. Applicant shall submit a site plan depicting emergency access routes, driveways and traffic circulation for Fire Department approval, as shown on the approved improvement plans for CT 92-02(A). 10. An all weather, unobstructed access road suitable for emergency service vehicles shall 4 be provided and maintained during construction. When in the opinion of the Fire Chief, the access road has become unserviceable due to inclement weather or other 5 reasons, he may, in the interest of public safety, require that construction operations cease until the condition is corrected.6 7 11. All required water mains, fire hydrants and appurtenances shall be operational before combustible building materials are located on the construction site. 8 12. Native vegetation which presents a fire hazard to structures shall be modified or 9 removed in accordance with the specifications contained in the City of Carlsbad Landscape Guidelines Manual, as shown on the approved landscape plans for CT 92-02(A), and as approved by the Fire Department. 11 13. The applicant shall provide a street map which conforms to the following 12 requirements: A 400 scale photo-reduction mylar, depicting proposed improvements and at least two existing intersections or streets.
