SUBJECT: Aviara Planning Area 28 (Bella Lago) - Appeal No. A6-97-CEB-123
Dear Mr. Grimm:
Commission staff has completed its preliminary review of the appeal filed for
City of Carlsbad coastal development permit no. 97-14 for construction of 61
single family homes in Aviara PA 28. A staff report has been prepared for the
December 10, 1997 Commission meeting recommending the Commission find that no
substantial issue is raised by the appeal. However, the final decision must
be made by the Coastal Commission and the City's CDP 97-14 is held in abeyance
until such action occurs.
In response to a question raised by the applicant regarding commencement of
construction of the model homes, we do not object to the issuance of building
permits for the model homes if there are LCP policies which exempt such
construction from needing a coastal development permit or a separate coastal
development permit authorization can occur for just the model homes.
Otherwise, authorization for construction of the homes will have to wait for
the Commission's decision on the appeal at the December 10, 1997 hearing. If
substantial issue is found, the item will be scheduled at a subsequent hearing
for de novo review.
