We believe the issues associated with the proposed project as to conformity with the certified Local Coastal Program (LCP) are significant. The report indicates there are impacts to 3.25 acres of wetland and riparian resources addressed in policies 3-7 and 3-8 of the cetrtified LCP land use plan, and to 8.5 acres of “dual criteria” slopes addressed in Policy 4-3 of the land use plan. We understand revisions may by made to the project to avoid direct wetland impacts and Commission staff encourages such changes. However, based on what we see as inconsistencies with the wetland and riparian resource protection policies, buffer requirements and policies protecting steep slopes and environmentally sensitive habitat areas, Commission staff would seek a Commission appeal of the project if approved by the Planning Commission as it is currently proposed. We appreciate the opportunity for input. We also would like to acknowledge that an amendment to the certified LCP would be the most effective means to reconcile any potential inconsistencies between the goals of the draft Habitat Management Plan and the currently certified LCP.
