SUBJECT: TERRAMAR BEACH HOUSE - CDP 97-32
Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your Coastal Development Permit, application no. 97-32, as to
its completeness for processing.
The application is incomplete, as submitted. Attached are two lists. The first list is
information which must be submitted to complete your application. This list of items must
be submitted directly to your staff planner by appointment. All list items must be
submitted simultaneously and a copy of this list must be included with your submittals. No
processing of your application can occur until the application is determined to be complete.
The second list is issues of concern to staff. When all required materials are submitted the
City has 30 days to make a determination of completeness. If the application is
determined to be complete, processing for a decision on the application will be initiated. In
addition, please note that you have six months from the date the application was initially
filed, August 12, 1997, to either resubmit the application or submit the required
information. Failure to resubmit the application or to submit the materials necessary to
determine your application complete shall be deemed to constitute withdrawal of the
application. If an application is withdrawn or deemed withdrawn, a new application must
be submitted.

Planning:

in the coastal zone. Specifically, it is development on the slope/hillside portion of
the lot and therefore requires a Hillside Development Permit; it is also development
within the Coastal High Hazard Area and therefore requires a Special Use Permit.
To make this aDDlication comdete, an amlication submittal deemed complete for a
SDecial Use Permit (SUP) and Hillside DeveloDment Permit (HDP) is required. The
City has 30 days after the initial submittal to determine completeness. Removing
drainage flow down the bluff face would eliminate the need for a SUP or HDP.
Staff recommends exploring drainage alternatives such as pumping to Carlsbad
Boulevard in addition to consulting with the Coastal Commission staff since the
subject project site is located in the Coastal appeal area. An approval by the City of
the CDP may be appealed by the Coastal Commission.
2. To show the project does not encroach into the Coastal Commission's permit
jurisdiction area, plot the location of mean high tide on the subject lot.
Engineering:
1. Provide more complete and precise topographical information for the site,
particularly the bluff top vicinity. Topographical information must be detailed
enough to reflect the existing drainage pattern as well as clearly identifying the bluff
top edge. The bluff top edge must clearly be shown for the subject lot as well as
the lots to the north and south because of the eastward curve in the bluff in this
area. This information will allow continued review of the drainage and bluff top
setback issues.
ISSUES OF CONCERN
Planning:
1. Blufftot, setback: This is a project issue that will be further reviewed. In addition to
Engineering Department's continued review of available geotechnical data and
reports, re-draw the structural setback string line so that it is parallel to the bluff
edge. Due to the curve of the bluff, a linear extension of the string line based on
the structure to the north with no adjustment for the bluff's orientation is of no use.
The setback will be based on the stringline and/or the geotechnical analysis based
on further review with the Engineering Department.
2. Buildinn height comdiance: Allow for clear demonstration of building height
compliance via project exhibits and the use of cross sections and spot elevations on
the rooftops and peaks. Building height is measured from finished or existing grade
(show both on all cross sections). Compliance with the 30 foot/2 story height limit
is required at all points along the building perimeter and within all points of building
coverage.
3. BlufftoD/bluff face drainaae: This is a project issue that will be further reviewed.
4. Blufftop aradinq: Blufftop grading or modification will not be allowed. Using more
detailed topographical information per Engineering Incomplete item #I above, this
issue will be further reviewed.
5. Confirm that City right of way is shown properly; see Engineering comment #4.
Landscaping may not be allowed in City right of way.
6. Six foot fence shown protruding into front yard setback area; 42 inches is allowed
maximum height for any retaining walls or fences in the front yard setback area.
7. South side roof projection can only exceed 2 feet into the side yard setback area.
Engineering:
1. Indicate height of wave run-up.
2. Provide a title report to review on-site easements.
3. Proposed off-site grading requires agreement letter from adjacent property owner.
4. Consult with Engineering staff to verify final future Carlsbad Boulevard
alignment/final improved typical section as it relates to the access driveway design.
