Dear Eric,
Enclosed is our resubmittal of the above project. Included with this letter are three copies each of
the revised landscape plan, the architectural plan, and the grading plan.
I have a few comments about the project that I would like to respond to in the order listed in your
letter to Larry Richards dated September 12, 1997.

1. Your letter dated the September 12, 1997, stated that we would need a Hillside
Development Permit and Special Use Permit because of the proposed bluff face
drainage pipe. Since we received your letter, we have had several meetings, and it has
been determined by Staff that draining over the bluff based on the original submitted
grading plan and the revised document would not constitute the need for a Hillside
Development Permit or the Special Use Permit (See attached letter to Mi-. Bob
Wojcik dated September 23, 1997.
2. We have added the mean high tide elevation as requested.

1. Per the request of Mr. Frank Jimeno, we have made the adjustments to the
topographical information as requested. In addition, we have added the topography
on the south edge of the property on the adjacent Jensen Site in the area of the bluff.

Bluff Top Setbacks. At your request, we have added a note to the grading plan
indicating the bluff setback based on geologic conditions and that the stringline
method does not apply. In addition, I have provided a copy of a peer review letter by
civil engineer David W. Skelly. He reviewed the two geologichoils reports dealing
with bluff retreat rates and indicated that the rates as reported were acceptable and
that he concurs with the 25-foot setback from the bluff top.
Building Height Compliance. The architectural plans have been revised to incorporate
the building height measured from finished or existing grade as shown in the various
elevations on the plans.
Bluff Top/Bluff Face Drainage. This issue has been cleared up as discussed in the
letter to Mr. Bob Wojcik dated September 23, 1997.
Bluff Top Grading. This issue has been noted on the plan.
The right-of-way is shown properly on the engineering drawings, in addition, the
landscaping plan has been modified to remove trees from the public right-of-way and
a note about owner to maintain landscaping in the public right-of-way.
The six foot fence has been modified and removed from the front yard setback area.
The south side roof projection has been modified to not exceed two feet into the side
yard setback area as requested.
Wave height run up has been added to the engineering drawing.
A title report was provided to Mr. Frank Jimeno at our last meeting with him.
I have attached a letter of permission from the adjacent owner, Mr. Jon Jensen. The
proposal is to build a six-foot retaining wall along the southerly property line. The
details of the retaining wall are shown on the revised grading plan.
We have shown the revised driveway grades for a possible future alignment of
Carlsbad Boulevard as suggested by Staff. The proposal is to build the driveway as
it currently is designed but to show that if Carlsbad Boulevard is ever raised, as shown
on the preliminary plan prepared for the City, that the driveway still works and can
be modified.

We have made all the changes that you have recommended. Also, Staff has come to a decision that
a Hillside Development Permit and Special Use Permit will not be required.
Please look over the attached information and revised documents and we look forward to your letter
accepting this project as a complete application. If you have any additional issues of concern, please
give us a call.
