This is to advise that the City of Carlsbad has approved the above described project on July 10, 2001, and has made the following determination regarding the above described project. A Negative Declaration was prepared for this project pursuant to the provisions of CEQA. 3. Mitigation measures were made a condition of the approval of the project. 4. A statement of Ovemding Considerations was not adopted for this project. 5. Findings were made pursuant to the provisions of CEQA. This is to certify that the final Negative Declaration with comments and responses and record of project approval is available to the General Public at THE CITY OF CARLSBAD. CIJNTY ON-..- City of Carlsbad 0 NEGATIVE DECLARATION Project AddressLocation: Kelly RancWSouth of Cannon Road and east of Faraday Avenue Project Description: Amend previously approved discretionary actions taken by the City of Carlsbad on the Kelly Ranch “Core Area” reducing the number of single family residential lots by eight, reducing the number of apartment units by 43, relocating future day care and recreational vehicle storage areas, establishing modified open space preservation areas, incorporating Kelly Ranch subdivision design elements of the Carlsbad Local Coastal Program, amending the General Plan land use map and incorporating new text into the Carlsbad Zoning Ordinance. The City of Carlsbad has conducted an environmental review of the above described project pursuant to the Guidelines for Implementation of the California Environmental Quality Act and the Environmental Protection Ordinance of the City of Carlsbad. As a result of said review, a 0 Negative Declaration (declaration that the project will not have a significant impact on the environment) is hereby issued for the subject project. Justification for this action is on file in the Planning Department. A copy of the Negative Declaration with supportive documents is on file in the Planning Department, 1635 Faraday Avenue, Carlsbad, California 92008. Comments fkom the public are invited. The City of Carlsbad Planning Department has completed an Environmental Initial Study for the above referenced property, including evaluation of the proposed project’s potential for adverse environmental impacts on fish and wildlife resources. 2.
