SUBJECT: CT 97-lS/CDP 97-48/CP 97-06 - POINSETTIA SHORES AREA “D”
Thank you for applying for Land Use Permits in the City of Carlsbad. The Planning
Department has reviewed your Tentative Tract Map/Coastal Development
Permit/Condominium Permit, application no. CT 97-19KDP 97-48KP 97-06, as to its
completeness for processing.
All of the items requested of you earlier have not been received and therefore your
application is still deemed incomplete. Listed below are the item(s) still needed in order to
deem your application as complete. This list of items must be submitted directly to your
staff planner by appointment. All list items must be submitted simultaneously and a copy
of this list must be included with your submittals. No processing of your application can
occur until the application is determined to be complete. When all required materials are
submitted the City has 30 days to make a determination of completeness. If the
application is determined to be complete, processing for a decision on the application will
be initiated. In addition, please note that you have six months from the date the
application was initially filed, November 5, 1997, to either resubmit the application or
submit the required information. Failure to resubmit the application or to submit the
materials necessary to determine your application complete shall be deemed to constitute
withdrawal of the application. If an application is withdrawn or deemed withdrawn, a new
application must be submitted.

Planning:
LIST OF ITEMS NEEDED
TO COMPLETE THE APPLICATION
1. You must demonstrate on the architectural elevations compliance with the City’s
building height regulations. The height must be measured from either the existing or
proposed grade (whichever is the more restrictive) to the peak of the structure.
2. The floor plans for Plans 2 and 3 call out a loft area. You will need to call out the
square footage of the loft portion individually and demonstrate compliance with the
City’s definition of a “loft” (copy enclosed). If the loft area does not comply with
the City’s “loft” definition, it must be counted as a “story” when calculating building
height.
3. The floor plans do not call out the dimensions of the proposed garages. This
information must be included on the plans.
4. The floor plan sheets for all of the structures call out square footages for
decks/balconies. However, the locations and dimensions of the decks are not
shown on the floor plan sheets for Plans 2 or 3. This information must be included
on the plans. (The information is provided for Plan 30. The information should be
provided for the other plans in a similar manner.)
5. The PFF Agreement provided requires an additional signature. As indicated on page
6 of the document, the signature of both the president or vice-president and the
secretary or assistant secretary are required. The president’s signature is on the
document. However, the secretary’s or assistant secretary’s signature is also
required. Staff is returning the original document to you for the additional signature
and notarization. Staff suggests you return the corrected form as quickly as
possible as the preliminary title report (which must accompany the PFF Agreement
and be no more than 6 months old) is dated November 6, 1997.
ISSUES OF CONCERN
Planning:
1. The floor plans contain a note indicating that the area calculations are “for Building
Department purposes only”. These notes will need to be removed from the plans.
Engineering:
Engineering Department staff has completed the 2”d review of the above-referenced project
for resolution of issues. The application and plans submitted for this proposed project are
not ready for approval and many of the previous comments are still unresolved.
Engineering issues which need to be resolved or adequately addressed prior to staff making
a determination on the proposed project are as follows:

Traffic and Circulation:
1. Please show the approved emergency access across lot 5. The final development plans
are in review and close to approval. Check with Fire Department regarding the closure
or gate of this access. Generally we cannot support the plan as shown.
2. Please show the full offsite improvements that will serve this project. Street “E” to
Avenida Encinas and the current street network proposed on lot 5. Identify the
maintenance and responsibility of this secondary access.
3. A detail of the Cul De Sac at the entrance’to this project should be shown to verify
turnaround of inaccessible vehicles. The Cul De Sac Turnaround will be required as part
of this project if a Gate system is proposed.
4. Please extend pedestrian access (i.e., concrete sidewalk) around the cul de sac to trail
access gate 972. From an Engineering view, gate #I could move to the north to better
serve this project as opposed to the location at the south end.
Sewer:
1. Please show existing easement and provide vehicle access to the proposed system.
The existing issue with this facility is large truck access and turnaround, tree planting in
an existing easement, and tree root intrusion or damage from vegetation. Contact Bill
Plummer or Randy Klausen to discuss this further. Consider the adjacent project (Area
B-l) and the similar solution to this issue.
Drainaae:
1. Please show the terminus of the off-site drainage at the north end of the site. Indicate
the easement rights of the proposed 38” private facility.
2. Please show the terminus of the on-site 18” drainage system at the north end of the
site. Indicate any easement rights needed offsite to handle this design.
Miscellaneous:
1. Please show what is proposed on the adjacent parcel (Lot 51, within 100’ of the
property boundary. The adjacent project is ahead of this with specific design and
location of units. Also show planning areas A-3 & A-4 and full improvements to
Avenida Encinas as approved.
2. Attached is a red-lined check print of the proposed project for the applicants use in
making the requested revisions. This check print must be returned with the project
revisions to facilitate continued staff review.
