Attached is a list of Planning Department issues of concern for the above referenced
project. Please note that these issues must be resolved prior to scheduling the project for
public hearing.

ISSUES OF CONCERN
Planning:
1. Any approval of this project will be conditioned to pay agricultural mitigation fees (per
the Master Plan).
2. The site plan (Sheet 3 of 3) will need to be corrected to match the landscape plan with
regard to the noise wall. The site plan still shows ‘a noise wall which exceeds 6’ in
height rather than the revised design (maximum 6’. in height combined with berming)
shown on the landscape plan.
3. The proposed landscaping along the--noise wall is shown on railroad-owned or other-
owned property (i.e., property not owned by the developer). This landscaping is also to
be located on top of a 20’ easement for sewer access. The necessary landscaping may
be incompatible with the need for vehicles (trucks) to use the easement. Also, the
degree of slope of the easement may make it difficult for the trucks to use it. This
situation could be exacerbated by the additional berming required to keep the noise wall
to a maximum height of 6’. These conditions/problems will need to be resolved so that
1) the easement can be used by the necessary vehicles, 2) the noise wall includes
berming to keep the height to 6’, 3) the noise wall is adequately landscaped, 4) the
necessary maintenance arrangements can be made satisfactorily. Staff suggests you
provide 2-3 cross-sections/profiles at the “worst case” points of the easement to assist
in finding the best solution to this issue. (See next item for a related issue.)
4. You will need to incorporate a gate in the noise wall to allow vehicular access to the
sewer access easement. You will need to provide a letter from the noise analyst
regarding this issue. The letter should address the impacts of incorporating the required
gate and any recommendations regafding the best location for it. (The current noise
study assumes and depends upon there being no cracks or openings in the wall.)
