I concur that the 50 foot riparian area buffer is to be measured from the riparian area and not the limits of a coastal commission deed restriction boundary. However, I do not know if the Coastal Commission Deed Restriction included any area beyond the limits of the resource for which it was required or if there is a discrepancy in delineating the boundaries of the riparian area. For purposes of processing the Coastal Development Permit I will apply the 50 foot buffer from the edge of the riparian area. The edge determination must be made by a qualified biologist and concurred with by representatives of the wildlife agencies.
