HomeMy WebLinkAboutCDP 97-58A; Carlsbad Park Estates; Coastal Development Permit (CDP) (5)MEMORANDUM DATE: October 25,1999 TO: FROM: Via: SUBJECT: Community Development Director Associate Planner, Anne Hysong Assistant Planning Director &Q MAY SUBDIVISION PUBLIC NOTICES In accordance with Chapter 21.54 of the Carlbad Municipal Code, public notices were published in the North County Times and sent to property owners within a 600 foot radius and occupants within a I00 foot radius IO days in advance of three public hearings conducted for the project. The first public notice was for a July 1, 1998 Planning Commission public hearing. The project was continued to the July 15,1998 hearing, however, no additional public notice is required for continued projects. The second public notice was for the September 8, 1998 City Council public hearing for an appeal of the items approved by the Planning Commission (CT 97- 24, CDP 97-58, SDP 98-05) and for the Zone Change and Local Coastal Program Amendment requiring Council approval. The third public notice was for the October 20, 1999 Planning Commission public hearing for an amendment to the approved coastal development permit and site development plan for units proposed on the lots. According to my review of the 600 foot radius map, all of the property owners identified on the attached list, received public notice for the 1998 public hearings with the exception of the resident identifying their address as 1736 Havens Pt. which does not exist in the area. The list of occupants is no longer a part of the file original files; therefore, I am unable to verify that the occupant at 3965 Scott Drive received a public notice for the first two public hearings, however, a notice was sent to the occupant for the October 20,1999 public hearing. Reply: From: Pat Kelley To: Lloyd Hubbs Date: 10/26/99 1 :04PM Subject: May Subdivision - Prentice Fencing Matter I reviewed the Prentice property this morning as it relates to the May subdivision grading. The Prentice fence was not in compliance with the current pool fence ordinance (subsequent to the grading). It is unlikely it complied before the grading, since it appears the fence was not 60 inches above grade. But the grading has exacerbated the non-compliance to a nominal degree, the slough from the slope has added some soil to the outside of the fence. The developer is slated to install a six foot masonry fence down the shared property line however according to Ms.Hysong. This will bring the Prentice's property line pool fencing adjacent to the May subdivision into compliance with the pool fence regulations which requires a 60" fence for the pool enclosure. At the same time, then, we would make a note and make sure she received notification when (and if) the item comes before Council. In fact, Julie must have given her my phone number because the lady called my number and left me a voicemail. Anyway - we'll see that she gets on Planning's List. It looks like they are going to add an additional 4" cap which will net a 68" wall. This ain't exactly 6' like the site plan shows. Planner on the project ought to contact the developer and advise them to add a course before grouting the wall. I would put it into written form for this little gem.. Pat >>> "Glen K. She said that if, as she has been informed in writing, her fence does not meet code for swimming pool enclosures, then the screen wall being constructed by the May Subdivision is not 6' tall. She said the wall needs to be 6 high, and requested that if upon inspection the City thinks that the wall is okay, to meet with her and explain it.
